Har trossamfunn rett til å forskjellsbehandle?
Aml 13 1. Direkte og indirekte diskriminering på grunn av politisk syn, medlemskap i arbeidstakerorganisasjon, seksuell orientering eller alder er forbudt. 3- Forskjellsbehandling som har et saklig formål, ikke er uforholdsmessig inngripende overfor den eller de som forskjellsbehandles og som er nødvendig for utøvelse av arbeid eller yrke, anses ikke som diskriminering etter loven her.
Er all forskjellsbehandling diskriminering? Diskriminering er illegitim forskjellsbehandling (dvs. ikke saklig, ikke nødvendig og uforholdsmessig inngripende) I noen tilfelle kan m.a.o. forskjellsbehandling forsvares, og er dermed ikke diskriminering Og i noen tilfelle kan det være nødvendig med en viss forskjellsbehandling for å sikre like rettigheter i praksis
Har trossamfunn rett til å forskjellsbehandle? Thlimmenos vs. Greece (ECtHR 2000) vern mot direkte og indirekte diskriminering The Court has so far considered that the right under Article 14 not to be discriminated against in the enjoyment of the rights guaranteed under the Convention is violated when States treat differently persons in analogous situations without providing an objective and reasonable justification. However, the Court considers that this is not the only facet of the prohibition of discrimination in Article 14. The right not to be discriminated against in the enjoyment of the rights guaranteed under the Convention is also violated when States without an objective and reasonable justification fail to treat differently persons whose situations are significantly different.
Employment Equality Directive (2000/78/EC) (1) The purpose of this Directive is to lay down a general framework for combating discrimination on the grounds of religion or belief, disability, age or sexual orientation as regards employment and occupation, with a view to putting into effect in the Member States the principle of equal treatment.

Art 4: generelt unntak for saklig forskjellsbehandling (4.1): Notwithstanding Article 2(1) and (2), Member States may provide that a difference of treatment which is based on a characteristic related to any of the grounds referred to in Article 1 shall not constitute discrimination where, by reason of the nature of the particular occupational activities concerned or of the context in which they are carried out, such a characteristic constitutes a genuine and determining occupational requirement, provided that the objective is legitimate and the requirement is proportionate.
Unntak for trossamfunn m.v. fra diskr.forbud på grl. av rel. (4.2): Member States may maintain national legislation in force at the date of adoption of this Directive or provide for future legislation incorporating national practices existing at the date of adoption of this Directive pursuant to which, in the case of occupational activities within churches and other public or private organisations the ethos of which is based on religion or belief, a difference of treatment based on a person's religion or belief shall not constitute discrimination where, by reason of the nature of these activities or of the context in which they are carried out, a person's religion or belief constitute a genuine, legitimate and justified occupational requirement, having regard to the organisation's ethos. This difference of treatment shall be implemented taking account of Member States' constitutional provisions and principles, as well as the general principles of Community law, and should not justify discrimination on another ground.
Lojalitetskrav (4.3)Provided that its provisions are otherwise complied with, this Directive shall thus not prejudice the right of churches and other public or private organisations, the ethos of which is based on religion or belief, acting in conformity with national constitutions and laws, to require individuals working for them to act in good faith and with loyalty to the organisation's ethos
Nasjonal diskrimineringsrett Lov om forbud mot diskriminering på grunn av etnisitet, religion mv. (diskrimineringsloven, 2005): Lovens formål er å fremme likestilling, sikre like muligheter og rettigheter og å hindre diskriminering på grunn av etnisitet, nasjonal opprinnelse, avstamning, hudfarge, språk, religion og livssyn.
4. Forbud mot diskriminering (1) Direkte og indirekte diskriminering på grunn av etnisitet, nasjonal opprinnelse, avstamning, hudfarge, språk, religion eller livssyn er forbudt.
Direkte diskriminering (2) Med direkte diskriminering menes at en handling eller unnlatelse har som formål eller virkning at personer eller foretak på grunnlag som nevnt i første ledd blir behandlet dårligere enn andre blir, er blitt eller ville blitt behandlet i en tilsvarende situasjon.
Indirekte diskriminering (3) Med indirekte diskriminering menes enhver tilsynelatende nøytral bestemmelse, betingelse, praksis, handling eller unnlatelse som fører til at personer på grunn av forhold som nevnt i første ledd blir stilt særlig ufordelaktig sammenliknet med andre.
Indirekte diskriminering i arbeidslivet (3) Med indirekte diskriminering i arbeidslivet menes enhver tilsynelatende nøytral bestemmelse, betingelse, praksis, handling eller unnlatelse som faktisk virker slik at en arbeidssøker eller arbeidstaker stilles dårligere enn andre arbeidssøkere eller arbeidstakere på grunn av forhold som nevnt i første ledd.
Unntak for saklig formål (4) Forskjellsbehandling som er nødvendig for å oppnå et saklig formål, og som ikke er uforholdsmessig inngripende overfor den eller de som forskjellsbehandles, anses ikke som diskriminering etter loven her.
