13. mai 2004 nr. 29 1 Overenskomster med fremmede stater nr. 1/2013 13. mai 2004 nr. 29 Protokoll nr. 14 til Konvensjonen om beskyttelse av menneskerettighetene og de grunnleggende friheter I henhold til kgl.res. av 7. mai 2004 ble protokollen undertegnet 13. mai 2004. I henhold til kgl.res. av 5. november 2004 ble protokollen ratifisert. Protokollen trådte i kraft 1. juni 2010. Det vises til St.prp.nr.4 (2004 2005), Innst.S.nr.16 (2004 2005) og til vedtak i Stortinget 28. oktober 2004. Protocol No. 14 to the Convention for the protection of human rights and fundamental freedoms, amending the control system of the Convention Preamble The member States of the Council of Europe, signatories to this Protocol to the Convention for the Protection of Human Rights and Fundamental Freedoms, signed at Rome on 4 November 1950 (hereinafter referred to as «the Convention»), Having regard to Resolution No. 1 and the Declaration adopted at the European Ministerial Conference on Human Rights, held in Rome on 3 and 4 November 2000; Having regard to the Declarations adopted by the Committee of Ministers on 8 November 2001, 7 November 2002 and 15 May 2003, at their 109 th, 111 th and 112 th Sessions, respectively; Having regard to Opinion No. 251 (2004) adopted by the Parliamentary Assembly of the Council of Europe on 28 April 2004; Considering the urgent need to amend certain provisions of the Convention in order to maintain and improve the efficiency of the control system for the long term, mainly in the light of the continuing increase in the workload of the European Court of Human Rights and the Committee of Ministers of the Council of Europe; Considering, in particular, the need to ensure that the Court can continue to play its pre-eminent role in protecting human rights in Europe, Have agreed as follows: Article 1 Paragraph 2 of Article 22 of the Convention shall be deleted. Article 2 Article 23 of the Convention shall be amended to read as follows: «Article 23 Terms of office and dismissal 1. The judges shall be elected for a period of nine years. They may not be re-elected. 2. The terms of office of judges shall expire when they reach the age of 70. 3. The judges shall hold office until replaced. They shall, however, continue to deal with such cases as they already have under consideration. 4. No judge may be dismissed from office unless the other judges decide by a majority of two-thirds that that judge has ceased to fulfil the required conditions.» Article 3 Article 24 of the Convention shall be deleted. Article 4 Article 25 of the Convention shall become Article 24 and its text shall be amended to read as follows: «Article 24 Registry and rapporteurs 1. The Court shall have a registry, the functions and organisation of which shall be laid down in the rules of the Court. 2. When sitting in a single-judge formation, the Court shall be assisted by rapporteurs who shall function under the authority of the President of the Court. They shall form part of the Court's registry.» Article 5 Article 26 of the Convention shall become Article 25 («Plenary Court») and its text shall be amended as follows: 1. At the end of paragraph d, the comma shall be replaced by a semi-colon and the word «and» shall be deleted.

A new paragraph f shall be added which shall read as follows: «f. make any request under Article 26, paragraph 2.» Article 6 Article 27 of the Convention shall become Article 26 and its text shall be amended to read as follows: «Article 26 Single-judge formation, committees, Chambers and Grand Chamber 1. To consider cases brought before it, the Court shall sit in a single-judge formation, in committees of three judges, in Chambers of seven judges and in a Grand Chamber of seventeen judges. The Court's Chambers shall set up committees for a fixed period of time. 2. At the request of the plenary Court, the Committee of Ministers may, by a unanimous decision and for a fixed period, reduce to five the number of judges of the Chambers. 3. When sitting as a single judge, a judge shall not examine any application against the High Contracting Party in respect of which that judge has been elected. 4. There shall sit as an ex officio member of the Chamber and the Grand Chamber the judge elected in respect of the High Contracting Party concerned. If there is none or if that judge is unable to sit, a person chosen by the President of the Court from a list submitted in advance by that Party shall sit in the capacity of judge. 5. The Grand Chamber shall also include the President of the Court, the Vice-Presidents, the Presidents of the Chambers and other judges chosen in accordance with the rules of the Court. When a case is referred to the Grand Chamber under Article 43, no judge from the Chamber which rendered the judgment shall sit in the Grand Chamber, with the exception of the President of the Chamber and the judge who sat in respect of the High Contracting Party concerned.» Article 7 After the new Article 26, a new Article 27 shall be inserted into the Convention, which shall read as follows: «Article 27 Competence of single judges 1. A single judge may declare inadmissible or strike out of the Court's list of cases an application submitted under Article 34, where such a decision can be taken without further examination. 2. The decision shall be final. 3. If the single judge does not declare an application inadmissible or strike it out, that judge shall forward it to a committee or to a Chamber for further examination.» Article 8 Article 28 of the Convention shall be amended to read as follows: «Article 28 Competence of committees 1. In respect of an application submitted under Article 34, a committee may, by a unanimous vote, a. declare it inadmissible or strike it out of its list of cases, where such decision can be taken without further examination; or b. declare it admissible and render at the same time a judgment on the merits, if the underlying question in the case, concerning the interpretation or the application of the Convention or the Protocols thereto, is already the subject of well-established case-law of the Court. 2. Decisions and judgments under paragraph 1 shall be final. 3. If the judge elected in respect of the High Contracting Party concerned is not a member of the committee, the committee may at any stage of the proceedings invite that judge to take the place of one of the members of the committee, having regard to all relevant factors, including whether that Party has contested the application of the procedure under paragraph 1. b.» Article 9 Article 29 of the Convention shall be amended as follows: 1. Paragraph 1 shall be amended to read as follows: «If no decision is taken under Article 27 or 28, or no judgment rendered under Article 28, a Chamber shall decide on the admissibility and merits of individual applications submitted under Article 34. The decision on admissibility may be taken separately.» 2. At the end of paragraph 2 a new sentence shall be added which shall read as follows: «The decision on admissibility shall be taken separately unless the Court, in exceptional cases, decides otherwise.» 3. Paragraph 3 shall be deleted.

13. mai 2004 nr. 29 3 Overenskomster med fremmede stater nr. 1/2013 Article 10 Article 31 of the Convention shall be amended as follows: 1. At the end of paragraph a, the word «and» shall be deleted. 2. Paragraph b shall become paragraph c and a new paragraph b shall be inserted and shall read as follows: «b. decide on issues referred to the Court by the Committee of Ministers in accordance with Article 46, paragraph 4; and». Article 11 Article 32 of the Convention shall be amended as follows: At the end of paragraph 1, a comma and the number 46 shall be inserted after the number 34. Article 12 Paragraph 3 of Article 35 of the Convention shall be amended to read as follows: «3. The Court shall declare inadmissible any individual application submitted under Article 34 if it considers that : a. the application is incompatible with the provisions of the Convention or the Protocols thereto, manifestly ill-founded, or an abuse of the right of individual application; or b. the applicant has not suffered a significant disadvantage, unless respect for human rights as defined in the Convention and the Protocols thereto requires an examination of the application on the merits and provided that no case may be rejected on this ground which has not been duly considered by a domestic tribunal.» Article 13 A new paragraph 3 shall be added at the end of Article 36 of the Convention, which shall read as follows: «3. In all cases before a Chamber or the Grand Chamber, the Council of Europe Commissioner for Human Rights may submit written comments and take part in hearings.» Article 14 Article 38 of the Convention shall be amended to read as follows: «Article 38 Examination of the case The Court shall examine the case together with the representatives of the parties and, if need be, undertake an investigation, for the effective conduct of which the High Contracting Parties concerned shall furnish all necessary facilities.» Article 15 Article 39 of the Convention shall be amended to read as follows: «Article 39 Friendly settlements 1. At any stage of the proceedings, the Court may place itself at the disposal of the parties concerned with a view to securing a friendly settlement of the matter on the basis of respect for human rights as defined in the Convention and the Protocols thereto. 2. Proceedings conducted under paragraph 1 shall be confidential. 3. If a friendly settlement is effected, the Court shall strike the case out of its list by means of a decision which shall be confined to a brief statement of the facts and of the solution reached. 4. This decision shall be transmitted to the Committee of Ministers, which shall supervise the execution of the terms of the friendly settlement as set out in the decision.» Article 16 Article 46 of the Convention shall be amended to read as follows: «Article 46 Binding force and execution of judgments 1. The High Contracting Parties undertake to abide by the final judgment of the Court in any case to which they are parties. 2. The final judgment of the Court shall be transmitted to the Committee of Ministers, which shall supervise its execution. 3. If the Committee of Ministers considers that the supervision of the execution of a final judgment is hindered by a problem of interpretation of the judgment, it may refer the matter to the Court for a ruling on the question of interpretation. A referral decision shall require a majority vote of two thirds of the representatives entitled to sit on the Committee.

13. mai 2004 nr. 29 4 Overenskomster med fremmede stater nr. 1/2013 4. If the Committee of Ministers considers that a High Contracting Party refuses to abide by a final judgment in a case to which it is a party, it may, after serving formal notice on that Party and by decision adopted by a majority vote of two thirds of the representatives entitled to sit on the Committee, refer to the Court the question whether that Party has failed to fulfil its obligation under paragraph 1. 5. If the Court finds a violation of paragraph 1, it shall refer the case to the Committee of Ministers for consideration of the measures to be taken. If the Court finds no violation of paragraph 1, it shall refer the case to the Committee of Ministers, which shall close its examination of the case.» Article 17 Article 59 of the Convention shall be amended as follows: 1. A new paragraph 2 shall be inserted which shall read as follows: «2. The European Union may accede to this Convention.» 2. Paragraphs 2, 3 and 4 shall become paragraphs 3, 4 and 5 respectively. Final and transitional provisions Article 18 1. This Protocol shall be open for signature by member States of the Council of Europe signatories to the Convention, which may express their consent to be bound by a. signature without reservation as to ratification, acceptance or approval; or b. signature subject to ratification, acceptance or approval, followed by ratification, acceptance or approval. 2. The instruments of ratification, acceptance or approval shall be deposited with the Secretary General of the Council of Europe. Article 19 This Protocol shall enter into force on the first day of the month following the expiration of a period of three months after the date on which all Parties to the Convention have expressed their consent to be bound by the Protocol, in accordance with the provisions of Article 18. Article 20 1. From the date of the entry into force of this Protocol, its provisions shall apply to all applications pending before the Court as well as to all judgments whose execution is under supervision by the Committee of Ministers. 2. The new admissibility criterion inserted by Article 12 of this Protocol in Article 35, paragraph 3. b of the Convention, shall not apply to applications declared admissible before the entry into force of the Protocol. In the two years following the entry into force of this Protocol, the new admissibility criterion may only be applied by Chambers and the Grand Chamber of the Court. Article 21 The term of office of judges serving their first term of office on the date of entry into force of this Protocol shall be extended ipso jure so as to amount to a total period of nine years. The other judges shall complete their term of office, which shall be extended ipso jure by two years. Article 22 The Secretary General of the Council of Europe shall notify the member States of the Council of Europe of: a. any signature; b. the deposit of any instrument of ratification, acceptance or approval; c. the date of entry into force of this Protocol in accordance with Article 19; and d. any other act, notification or communication relating to this Protocol. In witness whereof, the undersigned, being duly authorised thereto, have signed this Protocol. Done at Strasbourg, this 13 th day of May 2004, in English and in French, both texts being equally authentic, in a single copy which shall be deposited in the archives of the Council of Europe. The Secretary General of the Council of Europe shall transmit certified copies to each member State of the Council of Europe.

13. mai 2004 nr. 29 5 Overenskomster med fremmede stater nr. 1/2013 Protokoll nr. 14 til Konvensjonen om beskyttelse av menneskerettighetene og de grunnleggende friheter, om endring av konvensjonens kontrollsystem Fortale De medlemsstater i Europarådet som har undertegnet denne protokoll til Konvensjonen om beskyttelse av menneskerettighetene og de grunnleggende friheter, undertegnet i Roma 4. november 1950 (heretter kalt «konvensjonen»); som viser til resolusjon nr. 1 og erklæringen vedtatt på den europeiske ministerkonferansen om menneskerettigheter holdt i Roma 3. og 4. november 2000; som viser til erklæringene vedtatt på Ministerkomiteens 109., 111. og 112. sesjon henholdsvis 8. november 2001, 7. november 2002 og 15. mai 2003; som viser til uttalelse nr. 251 (2004) vedtatt av Europarådets parlamentarikerforsamling 28. april 2004; som tar i betraktning at det er et presserende behov for å endre visse bestemmelser i konvensjonen for å kunne opprettholde og bedre kontrollsystemets effektivitet på lengre sikt, hovedsakelig på bakgrunn av den stadig økende arbeidsbyrden som hviler på Den europeiske menneskerettsdomstol og Europarådets ministerkomité; som særlig tar i betraktning at det er nødvendig å sikre at Domstolen fortsatt kan spille sin ledende rolle med hensyn til vern av menneskerettighetene i Europa; er blitt enige om følgende: Artikkel 1 Konvensjonens artikkel 22, avsnitt 2 oppheves. Artikkel 2 Konvensjonens artikkel 23 skal lyde: «Artikkel 23 Embetsperioder og avskjedigelse 1. Dommerne velges for et tidsrom på ni år. De kan ikke gjenvelges. 2. Dommernes embetsperiode skal utløpe ved fylte 70 år. 3. Dommerne skal sitte i sine embeter til de skiftes ut. De skal imidlertid fortsatt behandle saker som de allerede har til vurdering. 4. En dommer kan ikke avskjediges fra embetet med mindre de øvrige dommerne med to tredjedels flertall avgjør at vedkommende ikke lenger oppfyller de fastsatte krav.» Konvensjonens artikkel 24 oppheves. Artikkel 3 Artikkel 4 Artikkel 25 i konvensjonen blir artikkel 24, og skal lyde: «Artikkel 24 Justissekretariat og rapportører 1. Domstolen skal ha et justissekretariat hvis funksjoner og organisering skal fastsettes i Domstolens forretningsorden. 2. Når Domstolen settes med enedommere, skal den bistås av rapportører som ved utøvelsen av sine funksjoner skal være underlagt Domstolens president. De skal utgjøre en del av Domstolens justissekretariat.» Artikkel 5 Artikkel 26 i konvensjonen blir artikkel 25 («Domstolen i plenum»), og skal endres som følger: 1. På slutten av punkt d erstattes komma med semikolon og ordet «og» utgår. 2. På slutten av punkt e erstattes punktum med semikolon. 3. Nytt punkt f skal lyde: «f. rette eventuelle anmodninger i henhold til artikkel 26, avsnitt 2.» Artikkel 6 Tidligere artikkel 27 i konvensjonen blir artikkel 26, og skal lyde: «Artikkel 26 Enedommere, komiteer, kamre og storkammer 1. Når Domstolen skal vurdere saker som er brakt inn for den, settes den med enedommere, komiteer på tre dommere, kamre på syv dommere og et storkammer på sytten dommere. Domstolens kamre skal nedsette komiteer for et fast tidsrom. 2. På anmodning fra Domstolen i plenum kan Ministerkomiteen, ved enstemmig vedtak og for et fast tidsrom, redusere antall dommere i kamrene til fem.

Når en dommer sitter som enedommer, skal vedkommende ikke behandle klager fremsatt mot den høye Kontraherende Part som vedkommende er valgt for. 4. Ex-officio-medlem av kammeret og storkammeret skal være den valgte dommer for den høye Kontraherende Part saken angår. Dersom ingen finnes eller vedkommende ikke kan møte, skal en person som Domstolens president har valgt fra en liste fremlagt på forhånd av vedkommende part, møte i egenskap av dommer. 5. Storkammeret skal også omfatte presidenten for Domstolen, visepresidentene, presidentene for kamrene og andre dommere valgt i samsvar med forretningsordenen. Når en sak er henvist til storkammeret i henhold til artikkel 43, skal ingen dommer som satt i kammeret som avsa dommen, sitte i storkammeret, med unntak av kammerets president og den dommer som var valgt for vedkommende høye Kontraherende Part.» Artikkel 7 Etter ny artikkel 26 innsettes ny artikkel 27 i konvensjonen, som skal lyde: «Artikkel 27 Enedommeres kompetanse 1. En enedommer kan beslutte å avvise eller stryke fra Domstolens saksliste en individklage innbrakt i henhold til artikkel 34 når slik beslutning kan treffes uten videre behandling. 2. Beslutningen skal være endelig. 3. Dersom enedommeren beslutter ikke å avvise en individklage eller stryke den fra sakslisten, skal vedkommende videresende den til en komité eller et kammer til videre behandling.» Artikkel 8 Konvensjonens artikkel 28 skal lyde: «Artikkel 28 Komiteers kompetanse 1. Ved individklager innbrakt i henhold til artikkel 34 kan en komité ved enstemmig vedtak a. beslutte å avvise klagen eller stryke den fra sakslisten når slikt vedtak kan fattes uten videre behandling; eller b. beslutte at klagen kan prøves og samtidig avsi dom om realitetsspørsmålene i saken dersom sakens underliggende spørsmål om tolkningen eller anvendelsen av konvensjonen eller dens protokoller, allerede er gjenstand for etablert rettspraksis ved Domstolen. 2. Vedtak og dommer i henhold til avsnitt 1 skal være endelige. 3. Dersom den valgte dommer for den høye Kontraherende Part saken angår, ikke er medlem av komiteen, kan komiteen på et hvilket som helst stadium i saksbehandlingen be vedkommende om å ta en av komitémedlemmenes plass, idet det tas hensyn til alle relevante faktorer, herunder om vedkommende part har hatt innsigelser mot å anvende fremgangsmåten i avsnitt 1. b.» Artikkel 9 Konvensjonens artikkel 29 skal endres som følger: 1. Avsnitt 1 skal lyde: «Dersom det ikke er fattet vedtak i henhold til artikkel 27 eller 28 eller avsagt dom i henhold til artikkel 28,skal et kammer avgjøre om individklager fremsatt i henhold til artikkel 34 kan prøves for Domstolen, og realitetene i saken. Vedtaket om hvorvidt saken kan prøves, kan fattes separat.» 2. På slutten av avsnitt 2 tilføyes en ny setning, som skal lyde: «Vedtak om hvorvidt saker kan prøves, skal fattes separat med mindre Domstolen unntaksvis bestemmer noe annet.» 3. Avsnitt 3 oppheves. Artikkel 10 Konvensjonens artikkel 31 skal endres som følger: 1. På slutten av punkt a utgår ordet «og». 2. Tidligere punkt b blir punkt c, og det innsettes nytt punkt b, som skal lyde: «b. avgjøre saker som Ministerkomiteen har forelagt for Domstolen i samsvar med artikkel 46, avsnitt 4; og». Artikkel 11 Konvensjonens artikkel 32 skal endres som følger: På slutten av avsnitt 1 innsettes et komma og tallet 46 etter tallet 34.

Domstolen skal avvise en individklage fremsatt i samsvar med artikkel 34 dersom den finner at a. klagen er uforenlig med bestemmelsene i konvensjonen eller dens protokoller, er åpenbart grunnløs eller innebærer et misbruk av retten til å fremsette individklage; eller b. klageren ikke har lidd noen ulempe av betydning, med mindre respekt for menneskerettighetene som definert i konvensjonen og dens protokoller krever at realitetsspørsmålene i saken blir behandlet, og forutsatt at ingen sak kan avvises på dette grunnlag som ikke har vært behørig vurdert av en nasjonal domstol.» Artikkel 13 På slutten av konvensjonens artikkel 36 skal nytt avsnitt 3 lyde: «3. alle saker som er til behandling i et kammer eller i storkammeret, kan Europarådets kommissær for menneskerettigheter legge frem skriftlige kommentarer og ta del i rettsmøter.» Artikkel 14 Konvensjonens artikkel 38 skal lyde: «Artikkel 38 Behandling av saken Domstolen skal behandle saken sammen med representantene for partene, og om nødvendig sette i verk en granskning, som de berørte høye Kontraherende Parter skal medvirke til ved å stille alle nødvendige hjelpemidler til disposisjon.» Artikkel 15 Konvensjonens artikkel 39 skal lyde: «Artikkel 39 Forlik 1. Domstolen kan på et hvilket som helst stadium i forhandlingene stille seg til disposisjon for de berørte parter med henblikk på å oppnå forlik i saken på grunnlag av respekt for menneskerettighetene som definert i konvensjonen og dens protokoller. 2. Forhandlinger i henhold til avsnitt 1 skal være konfidensielle. 3. Dersom det inngås forlik, skal Domstolen stryke saken fra sakslisten gjennom et vedtak som skal være begrenset til en kort redegjørelse for kjensgjerningene og den oppnådde løsning. 4. Dette vedtak skal overleveres Ministerkomiteen, som skal ha tilsyn med gjennomføringen av forliksvilkårene fastsatt i vedtaket.» Artikkel 16 Konvensjonens artikkel 46 skal lyde: «Artikkel 46 Dommers bindende kraft og deres iverksettelse 1. De høye Kontraherende Parter forplikter seg til å rette seg etter Domstolens endelige dom i enhver sak de er part i. 2. Domstolens endelige dom skal overleveres Ministerkomiteen, som skal ha tilsyn med fullbyrdelsen av dommen. 3. Dersom Ministerkomiteen finner at problemer med tolkningen av en endelig dom er til hinder for at den kan føre tilsyn med fullbyrdelsen av dommen, kan den oversende saken til Domstolen for å få avgjort tolkningsspørsmålet. Vedtak om å oversende saken krever to tredjedels stemmeflertall blant de representanter som har rett til å ta sete i Komiteen. 4. Dersom Ministerkomiteen finner at en høy Kontraherende Part nekter å rette seg etter en endelig dom i en sak den er part i, kan den etter å ha gitt vedkommende part formelt varsel og ved vedtak fattet med to tredjedels stemmeflertall blant de representanter som har rett til å ta sete i Komiteen, forelegge spørsmålet om parten har unnlatt å oppfylle sin forpliktelse etter avsnitt 1, for Domstolen. 5. Dersom Domstolen finner at det har funnet sted et brudd på avsnitt 1, skal den oversende saken til Ministerkomiteen, som skal vurdere hvilke tiltak som skal treffes. Dersom Domstolen finner at det ikke har funnet sted et brudd på avsnitt 1, skal den oversende saken til Ministerkomiteen, som skal avslutte behandlingen av saken.» Artikkel 17 Konvensjonens artikkel 59 skal endres som følger: 1. Det innsettes et nytt avsnitt 2, som skal lyde: «2. Den europeiske union kan tiltre denne konvensjon.» 2. Tidligere avsnitt 2, 3 og 4 blir henholdsvis avsnitt 3, 4 og 5.

Denne protokoll skal være åpen for undertegning av de medlemsstater i Europarådet som har undertegnet konvensjonen, og som kan gi sitt samtykke til å være bundet av den ved a. undertegning uten forbehold med hensyn til ratifikasjon, godtakelse eller godkjenning; eller b. undertegning med forbehold om ratifikasjon, godtakelse eller godkjenning, etterfulgt av ratifikasjon, godtakelse eller godkjenning. 2. Ratifikasjons-, godtakelses- eller godkjenningsdokumentene skal deponeres hos Europarådets generalsekretær. Artikkel 19 Denne protokoll trer i kraft den første dagen i den måned som følger etter utløpet av en periode på tre måneder regnet fra den dag alle parter i konvensjonen har gitt sitt samtykke til å være bundet av protokollen i samsvar med bestemmelsene i artikkel 18. Artikkel 20 1. Fra den dag denne protokoll trer i kraft, skal dens bestemmelser få anvendelse på alle klager som verserer for Domstolen, samt på alle dommer der Ministerkomiteen har tilsyn med fullbyrdelsen. 2. Det nye kravet med hensyn til hvorvidt en individklage kan prøves, innsatt ved artikkel 12 i denne protokoll i artikkel 35 avsnitt 3 b i konvensjonen, får ikke anvendelse på klager som Domstolen har erklært kan prøves før protokollen trådte i kraft. De to første årene etter at denne protokoll er trådt i kraft, er det bare Domstolens kamre og storkammer som kan anvende det nye kravet med hensyn til prøving av individklager. Artikkel 21 Embetsperioden for dommere som er inne i sin første embetsperiode den dag denne protokoll trer i kraft, skal automatisk forlenges til ni år til sammen. De øvrige dommerne skal fullføre sin embetsperiode, som automatisk forlenges med to år. Artikkel 22 Europarådets generalsekretær skal underrette medlemsstatene i Europarådet om a. enhver undertegning; b. deponering av ethvert ratifikasjons-, godtakelses- eller godkjenningsdokument; c. datoen da denne protokoll trer i kraft i samsvar med artikkel 19; og d. enhver annen handling, underretning eller meddelelse som angår denne protokoll. Som bekreftelse på dette har de undertegnede, som er gitt behørig fullmakt til det, undertegnet denne protokoll. Utferdiget i Strasbourg den 13. mai 2004 på engelsk og fransk, med samme gyldighet for begge tekster, i ett enkelt eksemplar, som skal deponeres i Europarådets arkiver. Europarådets generalsekretær skal oversende bekreftede kopier til hver av Europarådets medlemsstater.

I henhold til kgl.res. av 12. april 2013 ble avtalen ratifisert. Avtalen trådte i kraft 3. juli 2013. Det vises til Prop.106 S (2011 2012), Innst.203 S (2012 2013) og til vedtak i Stortinget 19. mars 2013. Convention on the rights of persons with disabilities Preamble The States Parties to the present Convention, a. Recalling the principles proclaimed in the Charter of the United Nations which recognize the inherent dignity and worth and the equal and inalienable rights of all members of the human family as the foundation of freedom, justice and peace in the world, b. Recognizing that the United Nations, in the Universal Declaration of Human Rights and in the International Covenants on Human Rights, has proclaimed and agreed that everyone is entitled to all the rights and freedoms set forth therein, without distinction of any kind, c. Reaffirming the universality, indivisibility, interdependence and interrelatedness of all human rights and fundamental freedoms and the need for persons with disabilities to be guaranteed their full enjoyment without discrimination, d. Recalling the International Covenant on Economic, Social and Cultural Rights, the International Covenant on Civil and Political Rights, the International Convention on the Elimination of All Forms of Racial Discrimination, the Convention on the Elimination of All Forms of Discrimination against Women, the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, the Convention on the Rights of the Child, and the International Convention on the Protection of the Rights of All Migrant Workers and Members of Their Families, e. Recognizing that disability is an evolving concept and that disability results from the interaction between persons with impairments and attitudinal and environmental barriers that hinders their full and effective participation in society on an equal basis with others, f. Recognizing the importance of the principles and policy guidelines contained in the World Programme of Action concerning Disabled Persons and in the Standard Rules on the Equalization of Opportunities for Persons with Disabilities in influencing the promotion, formulation and evaluation of the policies, plans, programmes and actions at the national, regional and international levels to further equalize opportunities for persons with disabilities, g. Emphasizing the importance of mainstreaming disability issues as an integral part of relevant strategies of sustainable development, h. Recognizing also that discrimination against any person on the basis of disability is a violation of the inherent dignity and worth of the human person, i. Recognizing further the diversity of persons with disabilities, j. Recognizing the need to promote and protect the human rights of all persons with disabilities, including those who require more intensive support, k. Concerned that, despite these various instruments and undertakings, persons with disabilities continue to face barriers in their participation as equal members of society and violations of their human rights in all parts of the world, l. Recognizing the importance of international cooperation for improving the living conditions of persons with disabilities in every country, particularly in developing countries, m. Recognizing the valued existing and potential contributions made by persons with disabilities to the overall well-being and diversity of their communities, and that the promotion of the full enjoyment by persons with disabilities of their human rights and fundamental freedoms and of full participation by persons with disabilities will result in their enhanced sense of belonging and in significant advances in the human, social and economic development of society and the eradication of poverty, n. Recognizing the importance for persons with disabilities of their individual autonomy and independence, including the freedom to make their own choices, o. Considering that persons with disabilities should have the opportunity to be actively involved in decision-making processes about policies and programmes, including those directly concerning them, p. Concerned about the difficult conditions faced by persons with disabilities who are subject to multiple or aggravated forms of discrimination on the basis of race, colour, sex, language, religion, political or other opinion, national, ethnic, indigenous or social origin, property, birth, age or other status,

Recognizing that women and girls with disabilities are often at greater risk, both within and outside the home of violence, injury or abuse, neglect or negligent treatment, maltreatment or exploitation, r. Recognizing that children with disabilities should have full enjoyment of all human rights and fundamental freedoms on an equal basis with other children, and recalling obligations to that end undertaken by States Parties to the Convention on the Rights of the Child, s. Emphasizing the need to incorporate a gender perspective in all efforts to promote the full enjoyment of human rights and fundamental freedoms by persons with disabilities, t. Highlighting the fact that the majority of persons with disabilities live in conditions of poverty, and in this regard recognizing the critical need to address the negative impact of poverty on persons with disabilities, u. Bearing in mind that conditions of peace and security based on full respect for the purposes and principles contained in the Charter of the United Nations and observance of applicable human rights instruments are indispensable for the full protection of persons with disabilities, in particular during armed conflicts and foreign occupation, v. Recognizing the importance of accessibility to the physical, social, economic and cultural environment, to health and education and to information and communication, in enabling persons with disabilities to fully enjoy all human rights and fundamental freedoms, w. Realizing that the individual, having duties to other individuals and to the community to which he or she belongs, is under a responsibility to strive for the promotion and observance of the rights recognized in the International Bill of Human Rights, x. Convinced that the family is the natural and fundamental group unit of society and is entitled to protection by society and the State, and that persons with disabilities and their family members should receive the necessary protection and assistance to enable families to contribute towards the full and equal enjoyment of the rights of persons with disabilities, y. Convinced that a comprehensive and integral international convention to promote and protect the rights and dignity of persons with disabilities will make a significant contribution to redressing the profound social disadvantage of persons with disabilities and promote their participation in the civil, political, economic, social and cultural spheres with equal opportunities, in both developing and developed countries, Have agreed as follows: Article 1 Purpose The purpose of the present Convention is to promote, protect and ensure the full and equal enjoyment of all human rights and fundamental freedoms by all persons with disabilities, and to promote respect for their inherent dignity. Persons with disabilities include those who have long-term physical, mental, intellectual or sensory impairments which in interaction with various barriers may hinder their full and effective participation in society on an equal basis with others. Article 2 Definitions For the purposes of the present Convention: «Communication» includes languages, display of text, Braille, tactile communication, large print, accessible multimedia as well as written, audio, plain-language, human-reader and augmentative and alternative modes, means and formats of communication, including accessible information and communication technology; «Language» includes spoken and signed languages and other forms of non spoken languages; «Discrimination on the basis of disability» means any distinction, exclusion or restriction on the basis of disability which has the purpose or effect of impairing or nullifying the recognition, enjoyment or exercise, on an equal basis with others, of all human rights and fundamental freedoms in the political, economic, social, cultural, civil or any other field. It includes all forms of discrimination, including denial of reasonable accommodation; «Reasonable accommodation» means necessary and appropriate modification and adjustments not imposing a disproportionate or undue burden, where needed in a particular case, to ensure to persons with disabilities the enjoyment or exercise on an equal basis with others of all human rights and fundamental freedoms;

13. des. 2006 nr. 34 11 Overenskomster med fremmede stater nr. 1/2013 «Universal design» means the design of products, environments, programmes and services to be usable by all people, to the greatest extent possible, without the need for adaptation or specialized design. «Universal design» shall not exclude assistive devices for particular groups of persons with disabilities where this is needed. Article 3 General principles The principles of the present Convention shall be: a. Respect for inherent dignity, individual autonomy including the freedom to make one's own choices, and independence of persons; b. Non-discrimination; c. Full and effective participation and inclusion in society; d. Respect for difference and acceptance of persons with disabilities as part of human diversity and humanity; e. Equality of opportunity; f. Accessibility; g. Equality between men and women; h. Respect for the evolving capacities of children with disabilities and respect for the right of children with disabilities to preserve their identities. Article 4 General obligations 1. States Parties undertake to ensure and promote the full realization of all human rights and fundamental freedoms for all persons with disabilities without discrimination of any kind on the basis of disability. To this end, States Parties undertake: a. To adopt all appropriate legislative, administrative and other measures for the implementation of the rights recognized in the present Convention; b. To take all appropriate measures, including legislation, to modify or abolish existing laws, regulations, customs and practices that constitute discrimination against persons with disabilities; c. To take into account the protection and promotion of the human rights of persons with disabilities in all policies and programmes; d. To refrain from engaging in any act or practice that is inconsistent with the present Convention and to ensure that public authorities and institutions act in conformity with the present Convention; e. To take all appropriate measures to eliminate discrimination on the basis of disability by any person, organization or private enterprise; f. To undertake or promote research and development of universally designed goods, services, equipment and facilities, as defined in article 2 of the present Convention, which should require the minimum possible adaptation and the least cost to meet the specific needs of a person with disabilities, to promote their availability and use, and to promote universal design in the development of standards and guidelines; g. To undertake or promote research and development of, and to promote the availability and use of new technologies, including information and communications technologies, mobility aids, devices and assistive technologies, suitable for persons with disabilities, giving priority to technologies at an affordable cost; h. To provide accessible information to persons with disabilities about mobility aids, devices and assistive technologies, including new technologies, as well as other forms of assistance, support services and facilities; i. To promote the training of professionals and staff working with persons with disabilities in the rights recognized in this Convention so as to better provide the assistance and services guaranteed by those rights. 2. With regard to economic, social and cultural rights, each State Party undertakes to take measures to the maximum of its available resources and, where needed, within the framework of international cooperation, with a view to achieving progressively the full realization of these rights, without prejudice to those obligations contained in the present Convention that are immediately applicable according to international law.

13. des. 2006 nr. 34 12 Overenskomster med fremmede stater nr. 1/2013 3. In the development and implementation of legislation and policies to implement the present Convention, and in other decision-making processes concerning issues relating to persons with disabilities, States Parties shall closely consult with and actively involve persons with disabilities, including children with disabilities, through their representative organizations. 4. Nothing in the present Convention shall affect any provisions which are more conducive to the realization of the rights of persons with disabilities and which may be contained in the law of a State Party or international law in force for that State. There shall be no restriction upon or derogation from any of the human rights and fundamental freedoms recognized or existing in any State Party to the present Convention pursuant to law, conventions, regulation or custom on the pretext that the present Convention does not recognize such rights or freedoms or that it recognizes them to a lesser extent. 5. The provisions of the present Convention shall extend to all parts of federal states without any limitations or exceptions. Article 5 Equality and non-discrimination 1. States Parties recognize that all persons are equal before and under the law and are entitled without any discrimination to the equal protection and equal benefit of the law. 2. States Parties shall prohibit all discrimination on the basis of disability and guarantee to persons with disabilities equal and effective legal protection against discrimination on all grounds. 3. In order to promote equality and eliminate discrimination, States Parties shall take all appropriate steps to ensure that reasonable accommodation is provided. 4. Specific measures which are necessary to accelerate or achieve de facto equality of persons with disabilities shall not be considered discrimination under the terms of the present Convention. Article 6 Women with disabilities 1. States Parties recognize that women and girls with disabilities are subject to multiple discrimination, and in this regard shall take measures to ensure the full and equal enjoyment by them of all human rights and fundamental freedoms. 2. States Parties shall take all appropriate measures to ensure the full development, advancement and empowerment of women, for the purpose of guaranteeing them the exercise and enjoyment of the human rights and fundamental freedoms set out in the present Convention. Article 7 Children with disabilities 1. States Parties shall take all necessary measures to ensure the full enjoyment by children with disabilities of all human rights and fundamental freedoms on an equal basis with other children. 2. In all actions concerning children with disabilities, the best interests of the child shall be a primary consideration. 3. States Parties shall ensure that children with disabilities have the right to express their views freely on all matters affecting them, their views being given due weight in accordance with their age and maturity, on an equal basis with other children, and to be provided with disability and age-appropriate assistance to realize that right. Article 8 Awareness-raising 1. States Parties undertake to adopt immediate, effective and appropriate measures: a. To raise awareness throughout society, including at the family level, regarding persons with disabilities, and to foster respect for the rights and dignity of persons with disabilities; b. To combat stereotypes, prejudices and harmful practices relating to persons with disabilities, including those based on sex and age, in all areas of life; c. To promote awareness of the capabilities and contributions of persons with disabilities. 2. Measures to this end include: a. Initiating and maintaining effective public awareness campaigns designed: i. To nurture receptiveness to the rights of persons with disabilities; ii. To promote positive perceptions and greater social awareness towards persons with disabilities; iii. To promote recognition of the skills, merits and abilities of persons with disabilities, and of their contributions to the workplace and the labour market;

Fostering at all levels of the education system, including in all children from an early age, an attitude of respect for the rights of persons with disabilities; c. Encouraging all organs of the media to portray persons with disabilities in a manner consistent with the purpose of the present Convention; d. Promoting awareness-training programmes regarding persons with disabilities and the rights of persons with disabilities. Article 9 Accessibility 1. To enable persons with disabilities to live independently and participate fully in all aspects of life, States Parties shall take appropriate measures to ensure to persons with disabilities access, on an equal basis with others, to the physical environment, to transportation, to information and communications, including information and communications technologies and systems, and to other facilities and services open or provided to the public, both in urban and in rural areas. These measures, which shall include the identification and elimination of obstacles and barriers to accessibility, shall apply to, inter alia: a. Buildings, roads, transportation and other indoor and outdoor facilities, including schools, housing, medical facilities and workplaces; b. Information, communications and other services, including electronic services and emergency services. 2. States Parties shall also take appropriate measures to: a. Develop, promulgate and monitor the implementation of minimum standards and guidelines for the accessibility of facilities and services open or provided to the public; b. Ensure that private entities that offer facilities and services which are open or provided to the public take into account all aspects of accessibility for persons with disabilities; c. Provide training for stakeholders on accessibility issues facing persons with disabilities; d. Provide in buildings and other facilities open to the public signage in Braille and in easy to read and understand forms; e. Provide forms of live assistance and intermediaries, including guides, readers and professional sign language interpreters, to facilitate accessibility to buildings and other facilities open to the public; f. Promote other appropriate forms of assistance and support to persons with disabilities to ensure their access to information; g. Promote access for persons with disabilities to new information and communications technologies and systems, including the Internet; h. Promote the design, development, production and distribution of accessible information and communications technologies and systems at an early stage, so that these technologies and systems become accessible at minimum cost. Article 10 Right to life States Parties reaffirm that every human being has the inherent right to life and shall take all necessary measures to ensure its effective enjoyment by persons with disabilities on an equal basis with others. Article 11 Situations of risk and humanitarian emergencies States Parties shall take, in accordance with their obligations under international law, including international humanitarian law and international human rights law, all necessary measures to ensure the protection and safety of persons with disabilities in situations of risk, including situations of armed conflict, humanitarian emergencies and the occurrence of natural disasters. Article 12 Equal recognition before the law 1. States Parties reaffirm that persons with disabilities have the right to recognition everywhere as persons before the law. 2. States Parties shall recognize that persons with disabilities enjoy legal capacity on an equal basis with others in all aspects of life. 3. States Parties shall take appropriate measures to provide access by persons with disabilities to the support they may require in exercising their legal capacity.

States Parties shall ensure that all measures that relate to the exercise of legal capacity provide for appropriate and effective safeguards to prevent abuse in accordance with international human rights law. Such safeguards shall ensure that measures relating to the exercise of legal capacity respect the rights, will and preferences of the person, are free of conflict of interest and undue influence, are proportional and tailored to the person's circumstances, apply for the shortest time possible and are subject to regular review by a competent, independent and impartial authority or judicial body. The safeguards shall be proportional to the degree to which such measures affect the person's rights and interests. 5. Subject to the provisions of this article, States Parties shall take all appropriate and effective measures to ensure the equal right of persons with disabilities to own or inherit property, to control their own financial affairs and to have equal access to bank loans, mortgages and other forms of financial credit, and shall ensure that persons with disabilities are not arbitrarily deprived of their property. Article 13 Access to justice 1. States Parties shall ensure effective access to justice for persons with disabilities on an equal basis with others, including through the provision of procedural and age-appropriate accommodations, in order to facilitate their effective role as direct and indirect participants, including as witnesses, in all legal proceedings, including at investigative and other preliminary stages. 2. In order to help to ensure effective access to justice for persons with disabilities, States Parties shall promote appropriate training for those working in the field of administration of justice, including police and prison staff. Article 14 Liberty and security of the person 1. States Parties shall ensure that persons with disabilities, on an equal basis with others: a. Enjoy the right to liberty and security of person; b. Are not deprived of their liberty unlawfully or arbitrarily, and that any deprivation of liberty is in conformity with the law, and that the existence of a disability shall in no case justify a deprivation of liberty. 2. States Parties shall ensure that if persons with disabilities are deprived of their liberty through any process, they are, on an equal basis with others, entitled to guarantees in accordance with international human rights law and shall be treated in compliance with the objectives and principles of this Convention, including by provision of reasonable accommodation. Article 15 Freedom from torture or cruel, inhuman or degrading treatment or punishment 1. No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment. In particular, no one shall be subjected without his or her free consent to medical or scientific experimentation. 2. States Parties shall take all effective legislative, administrative, judicial or other measures to prevent persons with disabilities, on an equal basis with others, from being subjected to torture or cruel, inhuman or degrading treatment or punishment. Article 16 Freedom from exploitation, violence and abuse 1. States Parties shall take all appropriate legislative, administrative, social, educational and other measures to protect persons with disabilities, both within and outside the home, from all forms of exploitation, violence and abuse, including their gender-based aspects. 2. States Parties shall also take all appropriate measures to prevent all forms of exploitation, violence and abuse by ensuring, inter alia, appropriate forms of gender- and age-sensitive assistance and support for persons with disabilities and their families and caregivers, including through the provision of information and education on how to avoid, recognize and report instances of exploitation, violence and abuse. States Parties shall ensure that protection services are age-, genderand disability-sensitive. 3. In order to prevent the occurrence of all forms of exploitation, violence and abuse, States Parties shall ensure that all facilities and programmes designed to serve persons with disabilities are effectively monitored by independent authorities.
