1 Respons Afghanistan/Pakistan: Afghanske flyktninger i Pakistan Problemstilling/spørsmål: Situasjonen/forholdene for afghanere i henholdsvis Pakistan og Iran: Hvor, helt konkret, finner man store bosteder/kolonier for afghanske flyktninger i nevnte land? Finnes det detaljerte kart tilgjengelig? Hva kjennetegner forholdene i disse bostedene/koloniene? Tilgang til jobb, helsevesen, skole, etc. Kan Landinfo gi konkrete opplysninger om tilstedeværelsen/fraværet av tillatelser til opphold, arbeid, flyktningstatus og lignende. Hvordan ser disse ut (har disse sett ut) fysisk? Er det stor grad av kontakt over landegrensene fra afghanske flyktninger i Pakistan/Iran til Afghanistan? Kan man lett reise frem og tilbake? Har Landinfo kjennskap til andre opplysninger som kan være betegnende for situasjonen/forholdene for afghanere i henholdsvis Pakistan og Iran? Afghanske flyktninger i Pakistan Denne responsen omhandler kun den delen av anmodningen som er relatert til afghanske borgere som oppholder seg i Pakistan. Landinfo anser UNHCR som den beste og mest etterrettelige kilden for opplysninger om denne befolkningen i Pakistan. De faktaopplysninger som presenteres i det følgende er derfor i all hovedsak basert på informasjon fra UNHCR. Geografisk beliggenhet av flyktningleire i Pakistan Det finnes en rekke gode kart og oversikter over flyktningleire i Pakistan. Leirene ligger i hovedsak langs grensen mot Afghanistan i provinsene North West Front Province (NWFP) og Balochistan. Det er UNHCR som utarbeider kartene. UNHCRs Current Population of Afghans in Refugee Villages NWFP (vedlegg 3) og Current Population of Afghans in Balochistan (vedlegg 4) gir god oversikt over de ulike leirenes beliggenhet i disse to provinsene. Sammen med UNHCRs Refugee Village Statistics (vedlegg 2) får man også en god oversikt over befolkningssammensetningen i de ulike leirenes mht. kjønn og alder. Det synes pr. mars 2009 å være 71 flyktningeleire i NWFP, 12 i Baluochistan og en i Punjab, med totalt ca beboere. Rapporten Assisted Voluntary Repatriation of Afghans from Pakistan Statistical Overview: Repatriation of Registered Afghans (with POR Cards) 01 March - 31 October 2008 (vedlegg 1) gir tilleggsinformasjon om returer fra Pakistan til Afghanistan og om den gjenværende afghanske befolkningen. Den afghanske befolkningen som bor utenfor flyktningleirene utgjør ca. 55 % av den totale afghanske befolkningen i Pakistan (norske ambassaden i Islamabad, e-post mars 2009). En stor del av denne befolkningen er født i Pakistan: Today, there are about 1.8 million registered Afghans in Pakistan and about half of this population actually was born and grew up in Pakistan so they have never seen Afghanistan. And they [refugees] tell us, this is part of the reasons, they are less willing to go back (Gul 2008). Sosiale forhold i leirene - helse/utdanning/arbeid I UNHCRs rapport Registration of Afghans in Pakistan 2007 (UNHCR 2007) finnes gode oversikter og kart om en rekke aspekter ved den afghanske befolkningen i Pakistan, både den som lever i flyktningleire (refugee villages) og den som lever utenfor leirene. Rapporten inneholder relevant informasjon om livsbetingelser og sosioøkonomiske forhold som kjønn, etnisitet, lokalisering, utdanning, inntektsforhold, spesielle behov, etc. Rapporten innholder også informasjon som gir grunnlag for å danne seg et bilde av lokalisering (se avsnittet over). UNHCR og organisasjonens partnere tilbyr helse-, utdanning- og ulike sosiale tjenester til den afghanske flyktningbefolkningen som er registrert bosatt i leirene. Hva gjelder arbeid antar Landinfo at både befolkningen i og befolkningen utenfor leirene må forholde seg til det pakistanske arbeidsmarkedet, som befolkningen for øvrig. Iht. den informasjon Landinfo har, organiserer verken UNHCR eller andre aktører tiltak rettet mot det pakistanske arbeidsmarkedet for den afghanske flyktningbefolkningen. Pakistanske myndigheter utsteder ikke arbeidstillatelser til afghanske borgere i Pakistan. Iht. UNHCR er mange afghanere i Pakistan engasjert i uregistert, ikke-faglig arbeid innenfor teglsteinsproduksjon, tekstilbransje, landbruk og transport (norske ambassaden i Islamabad, e- post mars 2009). Registrering og rettigheter Pakistanske myndigheter utsteder ikke tillatelser til opphold i Pakistan. Pakistan har ikke ratifisert Flyktningkonvensjonen og pakistanske myndigheter foretar derfor ingen individuell statusvurdering av afghanske borgere i Pakistan. UNHCR er imidlertid gitt anledning til å gjennomføre såkalt RSD (Refugee Status Determination) i Pakistan, under forutsetning av at afghanere som anerkjennes vil bli presentert for gjenbosetting i tredjeland. 3 In Pakistan Refugees and Asylum seekers (Afghan & Non Afghan) have no access to any form of free legal assistance on their status and durable solutions. SHARP, as an implementing partner of UNHCR has contributed in extending legal protection to Afghan refugees and Non-Afghan asylum seekers by registering their claims for Refugee Status Determination (RSD) in accordance with procedural standards of registration under the UNHCR mandate. Since 1999 the UNHCR-BOI has assigned SHARP with responsibility to register Afghan and Non-Afghan refugees/asylum seekers within Pakistan. SHARP has performed the responsibility with dedication and commitment and is currently implementing the project with competent team of lawyers and interpreters who are well versed with the subject of Refugee Protection. Partnership between UNHCR and SHARP is aimed to provide legal protection to Afghan refugees and Non-Afghan asylum seekers (SHARP (u.å.)). Afghanske flyktninger har slik Landinfo forstår det - på generelt grunnlag - blitt gitt anledning til midlertidig tålt opphold av pakistanske myndigheter. Det utstedes registreringskort, såkalte Proof of Registration Card (POR), til afghanske borgere som er registrert av myndighetene. I 2006 og 2007 ble det utstedt over 2 millioner POR. Disse er, iht. UNHCR, gyldige til 31. desember 2009 og gir innehaver anledning til å oppholde seg i Pakistan frem til dette tidspunkt. Utstedelsen av POR er basert på et Memorandum of Under-standing (MoU) mellom pakistanske myndigheter og UNHCR fra desember 2004 (Government of Pakistan 2004). 4 Afghanere som repatrierer med støtte fra UNHCR må gjennomgå en de-registrering foretatt av National Database and Registration Authority (NADRA). I forbindelse med deregistreringen kuttes POR nederst i høyre hjørne. Alle registrerte afghanere får altså utstedt et Proof of Registration Card som bl.a. inneholder individuelle biometriske data, og som pt. er gyldig frem til 31. desember Pakistanske myndigheter har, iht. UNHCR, i prinsippet gitt sin tilslutning til også å utvide gyldighetstiden ut over denne dato. Men dette er ikke formalisert ennå (norske ambassaden i Islamabad, e- post mars 2009) og det er derfor heller ikke utstedt POR med gyldighet ut over denne dato. Bevegelse over grensen Grensen mellom Afghanistan og Pakistan, Durand-linjen, er 2640 kilometer lang. Grenseområdene er preget av tildels svært utilgjengelig terreng og de to nasjonenes sjekkpunkter for overvåkning av grensen er ikke mange. Det er bred og lang tradisjon for trafikk i dette området og over denne grensen, eksempelvis ved nomader. Grensen representer derfor ikke en naturlig skillelinje for store befolkningsgrupper, både på pakistansk og afghansk side av grensen. Uregistrerte passeringer er både vanlig og akseptert. Generelt bør en imidlertid legge til grunn at forverringen i sikkerhetssituasjonen i mange av grenseområdene har påvirket bevegelsene over grensen. Antagelig også ved de to største av de etablerte grenseovergangene, Chaman i Balochistan og Torkham i Khyber. En respons er et svar på konkrete spørsmål og problemstillinger som saksbehandlere i utlendingsforvaltningen har stilt Landinfo. Responser er ikke ment å være utfyllende redegjørelser for et tema eller et spørsmål, men skal gi svar på de konkrete spørsmålene som er stilt, og ellers inneholde det som til enhver tid trengs av bakgrunnsinformasjon. 8 About this report All figures in this report refer to registered Afghans living in Pakistan who voluntarily repatriated with UNHCR assistance between 1 March and 31 October The return of Afghans from Pakistan is UNHCR s largest voluntary repatriation operation in the world. Since 2002, a total of 3,521,274 Afghans have returned home with UNHCR assistance. GoP s 3-Year Plan At the time of registration (October February 2007), the Government of Pakistan (GoP) agreed to permit registered Afghans living in Pakistan (and holding a valid POR card), to remain in the country until the expiry of the POR card at the end of With the rapidly deteriorating situation in Afghanistan and the challenges of return and reintegration, UNHCR advocated with the Pakistani authorities for a review of the 3-Year Plan for the Repatriation of Afghans. The revised Plan (to be finalized) will envision a more lenient return policy in alignment with the five-year Afghan National Development Strategy (ANDS) UNHCR in turn has committed to engage the support of the international community, other UN agencies as well as donor countries and partners to help the GoP in sharing the burden of delivery services to Afghans in the Country of Asylum. PCM Centers POR Card data can now be updated/corrected at the newly established PCM Centers. Following the registration exercise and the compilation of bio-data from over 2 million Afghans living in PAK, UNHCR/CAR together with NADRA (National Database and Registration Authority) have established four (of the five) POR Card Modification (PCM) Centers in Peshawar, Haripur, Quetta and Karachi (Lahore forthcoming). These Centers provide cards to children who have reached the age of 5, update information regarding births, deaths, marriages and correct errors such as misspelled names. Reasons to return During the 2008 repatriation season, the main reasons for return were the high cost of living in Pakistan (food, fuel, rent), especifically in urban areas, lack of employment and the deteriorating security situation. The expansion of military operations in FATA and the resulting measures taken by the authorities vis-à-vis illegal Afghans (without a POR card), such as detention, arrests, etc., and the expiration of the POR card at the end of 2009 also contributed to the decision of many Afghans to repatriate. Border Wheat/flour With the onset of the food crisis, soaring prices and GoP prohibition of wheat/flour export, border authorities continued their strict control of vehicles leaving PAK. While authorities tolerated the transport of to 2 bags of wheat flour (total of 40 kg) per returnee family for personal use, excess wheat/flour was confiscated. Smugglers were dealt with harshly. X-Border movement While border authorities employed stricter measures to control the flow of people and goods across the border, a large population of undocumented Afghans and Pakistanis continued to move in and out of the country every day for social, cultural, economic, medical and other reasons. Protection The Proof of Registration (POR) card issued to registered Afghans is recognized and honored by Pakistani authorities. Afghans with a POR card are assured of UNHCR assistance and services including access to health, education and intervention in case of (non-criminal) detention or arrest. Basic services in the VRCs Health: Afghans were referred to the Basic Health Units (BHUs) in each VRC. Major health issues included lower respiratory tract infection, gastrointestinal issues, diarrhea, cold and fever. Protection Clinic: at the VRCs received claims and cases requiring legal assistance. NRC is following up. 3

9 Protection Hotline: UNHCR has set up a 24/7 Hotline to respond to queries and provide information to those who are unable to reach UNHCR offices. The hotline will continue to operate during the winter repatriation break. Exit Questionnaires: Prompted by UNHCR AFG reports of harassment and corruption of Afghan returnees by PAK authorities, UNHCR PAK interviewed a large number of returnee families at the VRCs. The results of this survey confirmed the insignificant percentage of bribery, harassment or other difficulties for Afghans until they reach the VRCs. Due to the deteriorating security situation at the border areas, UNHCR border monitors worked by remote and were unable to monitor crossings more closely. Other observations Reverse flow There were reports of new arrivals (Afghans to PAK) on a daily basis. While many of these were newcomers, many were also formerly registered Afghans who had repatriated only to return to PAK with an invalidated PoR card. There are no confirmed numbers for this population at this time. Change of Destination Many Afghans returned to the main cities rather than their place of origin in order to seek greater employment, education, health, etc. opportunities. Borrowed babies A number of families claimed to have newborn babies in order to receive an additional cash grant. Cases found to be doubtful were rejected (e.g. two babies born to the same mother in the same year but not twins) Repatriation of Minors Many minors approached the VRC claiming that their parents had deceased. Interviews frequently revealed that parents were alive but may have repatriated once before or that the families were in need of the cash grant in order to make ends meet. Repatriation statistics Assisted voluntary repatriation figures are as follows: in 2008 a total of 282,496 Afghans returned to Afghanistan. The number of returns in 2007 stood at 364,476; of these, 206,128 1 received repatriation assistance during the grace period, a six-week window of return from 1 March to 15 April reserved as a last opportunity for unregistered Afghans (those not holding a POR card) to return to their country with UNHCR assistance. After 15 April 2007, Afghans without a POR card have not been eligible to receive assistance. In 2007, another 159,535 registered Afghans returned home between 16 April and 31 October In 2006, 133,015 Afghans returned to Afghanistan; in 2005 the figure was 449,520; in 2004, 383,598 and in 2003, 343,074 Afghans repatriated with the help of the UN Refugee Agency. UNHCR registered a record 1.56 million returns (excluding the spontaneous or un-assisted returns) in All unregistered Afghans are considered illegal immigrants by the GoP and are subject to the laws of the land. However, UNHCR has negotiated with the GoP so that all Afghans (with or without a POR card) with a legitimate need for protection will continue to have access to UNHCR on an individual basis and will be processed accordingly. To be eligible for assisted repatriation and to receive the cash grant offered by UNHCR, all registered Afghans must approach one of the UNHCR Voluntary Repatriation Centers (VRCs) Hayatabad in Peshawar (NWFP) or Baleli near Quetta (Balochistan) and successfully complete various steps including deregistration by NADRA (National Database and Registration Authority), physical invalidation of the POR card (by cutting the corner of the POR card), Iris recognition ( IRIS sticker is issued) to ensure that the person has not received UNHCR assistance before, the issuance of a Voluntary Repatriation Form (VRF) for each family and a medical check. Returnees may also refer to the Protection Clinic on the VRC premises should they have legal queries. Returnees receive their cash grant at the designated Encashment Center (EC) upon arrival in Afghanistan. 10 requested by the Government of Pakistan (GoP) and agreed upon during the meeting of the Tripartite Commission. The exact amount of the grant varies according to distance to the final destination and is intended to help cover the cost of transportation and to provide reintegration assistance upon return to Afghanistan. Summary of Repatriation Trends Returns by province of registration in Pakistan From 1 March to 31 October 2008: 81% of Afghans in Pakistan returned from NWFP, 3% from Sindh, 8 % from the Punjab & Islamabad and 8 % from Balochistan. The total number of returnees from 1 March 2008 to 31 October 2008 is 282,496 (this figure includes recyclers who were processed but failed the IRIS verification/recognition test. This means that they were deregistered (their PoR card was invalidated) but they did not receive assistance (cash grant) from UNHCR (c. 4,958 individuals see page 9) Returns from refugee villages (RVs) vs. non-rvs From 1 March 31 October 2008, 43% of Afghan returnees were from a refugee village (RV) in Pakistan and 57% from outside RVs. In 2007 (as of 16 April), 57% of Afghans repatriated from RVs, 43% repatriated from outside these sites. During the 2007 grace period (1 March-15 April), 6% of the Afghans returned from RVs while 94% were from outside RVs (urban areas). In 2006, 30% of total returns were from RVs; in %, in % and in 2003, 31% of repatriates were former RV residents in Pakistan. In 2004 and 2005, the percentage of returns from RVs increased due to the fact that UNHCR and the GoP announced the closure of Rs in the FATA area near the Afghan border. Ethnicity Some 90 % Pashtuns and 6% Tajiks have repatriated from. In % of the registered Afghans who repatriated were Pashtun and 9% were Tajik; during the grace period, 95% of returnees (non-por card holders) were ethnic Pashtuns and 3 % were Tajiks. Pashtuns made up 40% of Afghans who repatriated to Nangarhar (2008), 9% of returns to Kabul, 7% of those who went back to Kunduz and 0.39% of those going back to Ghazni. While Tajiks made up 36% of Afghans going to Nangarhar, 27% of returnees to Kabul, 7% of Afghans going to Kunduz, 3.02% of those repatriating to Parwan and 5% of the population going to Baghlan from Pakistan. Returns by area of origin and final destination in Afghanistan The majority of returnees or 39% of Afghan who returned in 2008 went back to Nangarhar province, 10% returned to Kabul, 12% returned to Kunar, 8% went back to Laghman and 7.30% to Kunduz. Education 2% of the returning Afghans had completed primary, and 1% secondary education. IRIS Verification The Iris scanning and verification system was introduced in Initially it was for all returnees above the age of 12 years but later reviewed and reduced to those 5 years of age and above. Children below 5 years of age are not scanned due to the difficulty in getting them to focus on the scanning lense for the desired period of time. The Iris test is to ensure that the system is not abused and that recyclers are identified and barred from receiving repatriation assistance more than once. The ratio of persons recognized at the Iris scanning stage i.e. rejected for repatriation by the Iris Recognition Database during the reporting period, is 2%. 75% of the Afghans who approached the VRCs were successfully enrolled; this excludes children under 5 5

11 years of age and those who did not undergo the IRIS test (due to disability, etc.). The age limit for the Iris recognition test was lowered from 12 to 5 years in July Note about the statistics The figures in this report may appear different to those of the Daily Repatriation Reports. This is because repatriation data is collected manually in the field, submitted to respected sub-offices (Quetta / Peshawar) at the end of each day, then transferred to Branch Office Islamabad where all data is compiled and final reports are generated. There is a margin of error and a time delay in the processing so that while daily statistics may indicate one figure, the overall figures may reflect another. 6
