Innledning I dette rundskrivet gjøres rede for nye konvensjonsbestemmelser vedtatt i 2004 av betydning for rett til sjømannspensjon og for plikten for rederier/sjømenn til å svare pensjonsavgift til Pensjonstrygden for sjømenn. De nye konvensjonsbestemmelsene gjelder for det første EU/EØS-utvidelsen fra 1. mai 2004. Dessuten gjelder det innføring av ny nordisk trygdekonvensjon fra 1.9.2004. 2. EU/EØS-utvidelsen fra 1. mai 2004 2.1 Generelt 2.1.1 Hovedregel Statsborgere fra land innen EU/EØS-området som er arbeidstakere om bord på norskregistrerte skip (NOR eller NIS) er som hovedregel pliktig omfattet av Pensjonstrygden for sjømenn på samme måte som norske statsborgere. Dette følger av EØS-avtalen og Rådsforordning (EØF) nr. 1408/71 om trygd, artikkel 13 nr. 2 bokstav c. For tiden er statsborgere fra i alt 27 land utenom Norge omfattet av Pensjonstrygden for sjømenn etter hovedbestemmelsene i EØS-avtalen/forordningen, jf. oppregningen nedenfor med opplysning om når trygdeplikten tok til. Trygdeplikten gjelder uansett hvor disse statsborgere er bosatt. Statsborgere fra land utenfor EU/EØS-området omfattes ikke av Pensjonstrygden for sjømenn i henhold til disse bestemmelser selv om de er bosatt i et EU/EØS-land utenom Norge. Se imidlertid andre bestemmelser nedenfor under pkt. 3 i forhold til den nye nordiske trygdekonvensjonen. Konsekvensen av at statsborgere innen EU/EØS-området er pliktig omfattet av Pensjonstrygden for sjømenn er at rederiet og den enkelte sjømann plikter å svare pensjonsavgift til Pensjonstrygden for sjømenn på samme måte som norske statsborgere og personer med fast bopel i Norge som tjenestegjør på norske skip (NOR eller NIS) som kommer inn under trygden. Den opprinnelige EØS-avtalen/Rådsforordningen omfattet fra 1.1.1994 statsborgere fra følgende 16 EU/EØS-land i tillegg til Norge (NO) (landkodene står i parantes): Belgia (BE), Danmark (DK), Finland, (FI), Frankrike med visse oversjøiske områder (FR), Hellas (GR), Irland (IE), Island (IS), Italia (IT), Luxembourg (LU), Nederland (NL), Portugal (PT), Spania (ES), Storbritannia (GB), Sverige (SE), Tyskland (DE), og Østerrike ( AT). Fra 1.5.1995 kom også statsborgere fra Liechtenstein (LI) med.
Fra 1.6.2002 ble det inngått en bilateral avtale mellom Sveits (CH) og EU/EØS som medfører at også sveitsiske statsborgere omfattes av pensjonstrygden for sjømenn under tjeneste på norske skip (NOR eller NIS) på samme måte som EU/EØS-borgere. Fra 1.5.2004 ble EU/EØS utvidet med ytterligere 10 land slik at også statsborgere fra følgende land omfattes av Pensjonstrygden for sjømenn under tjeneste på norske skip (NOR eller NIS): Estland (EE), Kypros (CY), Latvia (LV), Litauen (LT), Malta (MT), Polen (PL), Slovakia (SK), Slovenia (SI), Tsjekkia (CZ) og Ungarn (HU). 2.1.2 Generelle unntak Etter pensjonstrygdlovens 2 nr. 2 annet ledd er personer som er ansatt i hotell- og restaurantvirksomhet om bord på turistskip registrert i NIS unntatt fra Pensjonstrygden for sjømenn. Dette unntaket gjelder generelt, dvs. også for norske statsborgere, øvrige EU/EØS-borgere, samt for tredjelands borgere med bopel innen Norden. Det er også generelle unntaksbestemmelser i EØS-avtalens trygdedel. En arbeidstaker som mottar lønn fra arbeidsgiver i bostedslandet, skal for eksempel være omfattet av bostedslandets trygdesystem, jf. Rådsforordning 1408/71, artikkel 14 b nr. 1-4. Unntak forutsetter at bostedslandets trygdemyndighet bekrefter medlemskap i dette landets trygdesystem. Etter artikkel 17 i EØS-forordningen er det adgang for to eller flere EU/EØS-lands kompetente myndigheter til å avtale unntak fra bestemmelsene om hvilke lands pensjons- og trygde - lovgivning som får anvendelse. I forhold til Pensjonstrygden for sjømenn er det hittil inngått avtaler om unntak for sjømenn fra Polen og Latvia, se nedenfor under pkt. 2.2. 2.2 Særskilte unntak for polske og latviske sjømenn på NIS-skip Med virkning fra 1.5.2004 ble det inngått avtale 2.7.2004 mellom Polen og Norge om trygd i hjemlandet og unntak fra norsk trygd, herunder Pensjonstrygden for sjømenn, for polske sjømenn på NIS-skip. Tilsvarende ble det 18.11.2004 inngått avtale mellom Latvia og Norge om trygd i hjemlandet og unntak fra norsk trygd, herunder Pensjonstrygden for sjømenn, for latviske sjømenn på NIS-skip. Sistnevnte avtale er midlertidig og vil være i kraft t.o.m. 30.4.2006, med mulighet til forlengelse etter felles samtykke av de kompetente myndigheter. Avtalene omfatter ikke polske og latviske sjømenn på NOR-skip. Disse omfattes derfor pliktig av Pensjonstrygden for sjømenn etter hovedreglene nevnt ovenfor under pkt 2.1.1. Avtalene innebærer en klar forpliktelse for Folketrygdkontoret for utenlandssaker (FFU) som norsk kompetent institusjon til å godta korrekt utstedte polske og latviske blanketter om trygd i hjemlandet. Bekreftelse skal gis på blankett E 101 eller på tilsvarende måte. Ansvaret for opptak i polsk/latvisk trygd og utstedelse av blanketter etter avtalen er imidlertid et eksklusivt polsk/latvisk ansvar. Eventuelle klager i denne forbindelse må rettes direkte til polske/latviske myndigheter. Innberetning av lønn og innbetaling av avgifter til Pensjonstrygden for sjømenn skal på vanlig måte skje i 6 årlige terminer, med forfall den 20. i måneden etter utløpet av den enkelte termin. For den som tiltrer tjeneste i begynnelsen av innberetningperioden, vil dette gi en frist på 2 måneder eller mer til å sørge for de nødvendige bekreftelser til FFU om trygd i bostedslandet. Vi minner om at rederiet er ansvarlig for arbeidstakeravgiften for enhver trygdepliktig arbeidstaker om bord og innbetaling av den, og har rett til å trekke den fra hyreoppgjøret. Unnlater rederiet dette, kan avgiften ikke kreves hos arbeidstakeren når det har gått 3 måneder fra hyreoppgjøret.
Arbeids- og sosialdepartementet har gitt følgende retningslinjer om fleksibilitet ved avgiftsinnkrevingen i forhold til disse avtalene: Innkreving av avgifter til Pensjonstrygden for sjømenn utsettes i to kalendermåneder etter den måneden da sjømenn fra Polen/Latvia tiltrådte tjeneste på NIS-skip, idet det antas at sjømannen skal være underlagt lovgivningen i bostedslandet. Pensjonstrygden for sjømenn gis melding om dette på vanlig måte. Dersom FFU ikke mottar dokumentasjon for trygd i hjemlandet i løpet av fristen, iverksettes innkreving av avgifter for hele perioden etter tiltredelse på skipet. Ved dokumentasjon etter fristen gis unntak fra Pensjonstrygden for sjømenn med tilbakevirkning, og eventuelle innbetalte pensjonsavgifter refunderes. 3. Ny nordisk trygdekonvensjon fra 1.9.2004 De nordiske land (Danmark, Finland, Island, Norge og Sverige) undertegnet 18.8.2003 en ny nordisk trygdekonvensjon som trådte i kraft 1.9.2004 og som erstattet den tidligere nordiske trygdekonvensjonen av 15.6.1992. Den nye konvensjonen får anvendelse på all lovgivning som omfattes av Rådsforordning (EØF) nr 1408/71, dvs. også for lov om pensjonstrygd for sjømenn. Konvensjonen hjemler adgang også for de selvstyrte områdene Færøyene, Grønland og Åland til å omfattes av konvensjonen i den utstrekning disse områdene gir sitt samtykke til dette. Personer født på Grønland og Færøyene er danske statsborgere og skal betale avgift til trygden. For Pensjonstrygden for sjømenn får den nye nordiske konvensjonen selvstendig betydning utover forordningens bestemmelser ved at tredjelandsborgere (utenom EU/EØS-området) som er fast bosatt i et av de øvrige nordiske land, kommer inn under pensjonstrygden når de tjenestegjør på norske skip (NOR eller NIS) som går inn under trygden. Eksempelvis vil en filippiner bosatt i Sverige, eller en russer bosatt i Finland, være omfattet av Pensjonstrygden for sjømenn når han tjenestegjør på norsk skip (NOR eller NIS) som går inn under trygden. Rederiet skal således på ordinær måte foreta trekk, innsende avgiftsoppgaver og innbetale arbeidstaker- og rederiavgift også for tredjelandsborgere bosatt i Danmark, Finland, Island og Sverige. Introduction In this Circular an account is given of new Convention provisions passed in 2004 of significance for seaman s pension and for the obligation of shipping companies/seamen to pay pension contributions to the Pension Insurance for Seamen. The new Convention provisions apply to the first extension of the EU/EEA from 1 May 2004. Moreover, they apply to the introduction of a new Nordic National Insurance Convention from 1 September 2004. 2. The extension of the EU/EEA from 1 May 2004 2.1 General 2.1.1 Primary rule Citizens from countries within the EU/EEA area who are employees on board Norwegianregistered ships (NOR or NIS) are as a primary rule encompassed by the Pension Insurance for Seamen in the same way as Norwegian citizens. This is a result of the EEA Agreement and Council Decree (EEC) No. 1408/71 concerning National Insurance, Article 13 No. 2 Litra c. Currently citizens from a total of 27 countries other than Norway are encompassed by the Pension Insurance for Seamen under the primary provisions of the EEA Agreement and the Decree; cp. the list below with information on when this pension insurance obligation began. The pension insurance obligation applies regardless of where these citizens are domiciled. Citizens from countries outside the EU/EEA are not encompassed by the Pension Insurance for Seamen pursuant to these provisions, even if they are domiciled in an EU/EEA country other than Norway. However, see other provisions below under Section 3 in relation to the new Nordic National Insurance Convention. The consequence of the fact that citizens within the EU/EEA area are compulsorily encompassed by the Pension Insurance for Seamen is that the shipping company and the individual seaman are obliged to pay pension contributions to the Pension Insurance for Seamen in the same way as Norwegian citizens and persons permanently domiciled in Norway who serve on Norwegian ships (NOR or NIS) covered by the Pension Insurance. Since 1 January 1994 the original EEA Agreement/Council Decree has encompassed citizens from the following 16 EU/EEA countries in addition to Norway (NO): Belgium (BE), Denmark (DK), Finland (FI), France with certain overseas areas (FR), Greece (GR), Ireland (IE), Iceland (IS), Italy (IT), Luxembourg (LU), The Netherlands (NL), Portugal (PT), Spain (ES), United Kingdom (UK), Sweden (SE), Germany (DE), and Austria (AT). Since 1 May 1995 citizens from Liechtenstein (LI) have also been encompassed.
A bilateral agreement was signed between Switzerland (CH) and the EU/EEA from 1 June 2002 which means that Swiss citizens are also encompassed by the Pension Insurance for Seamen during service on Norwegian ships (NOR or NIS) in the same way as EU/EEA citizens. From 1 May 2004 the EU/EEA was extended to include a further 10 countries, so that citizens from the following countries are also encompassed by the Pension Insurance for Seamen during service on Norwegian ships (NOR or NIS): Estonia (EST), Cyprus (CY), Latvia (LV), Lithuania (LT), Malta (MT), Poland (PL), Slovakia (SK), Slovenia (SI), Czechia (CZ) and Hungary (HU). 2.1.2 General exceptions Under 2 No. 2 2 nd subsection, persons employed in the hotel and restaurant business on board tourist ships registered in NIS are excepted from the Pension Insurance for Seamen. This exception applies in general, in other words also to Norwegian citizens, other EU/EEA citizens, as well as to citizens of other countries who are domiciled in a Nordic country. There are also general provisions governing exceptions in the national insurance section of the EEA Agreement. For example, an employee who receives wages from an employer in the country of residence shall be encompassed by the national insurance system of the country of residence; cp. Council Decree 1408/71, Article 14 b Nos 1-4. A prerequisite for exception is that the national insurance authorities of the country of residence confirm membership of this country s national insurance scheme. Under Article 17 of the EEA Decree the competent authorities of two or more EU/EEA countries have a right to agree exceptions from the provisions concerning which countries pension and national insurance legislation shall apply. In relation to the Pension Insurance for Seamen, so far agreements concerning exception for seamen from Poland and Latvia have been entered into; see below under Section 2.2. 2.2 Special exceptions for Polish and Latvian seamen on NIS ships With effect from 1 May 2004 an agreement was entered into 2 July 2004 between Poland and Norway concerning national insurance in the home country and exception from the Norwegian national insurance scheme, including the Pension Insurance for Seamen, for Polish seamen on NIS ships. 18 November 2004 a corresponding agreement was entered into between Poland and Norway concerning national insurance in the home country and exception from the Norwegian national insurance scheme, including the Pension Insurance for Seamen, for Latvian seamen on NIS ships. The latter agreement is temporary and will be in effect up to and including 30 April 2006, with the option of prolongation subject to mutual agreement by the competent authorities. The agreements do not include Polish and Latvian seamen on NOR ships. Thus, these are compulsorily encompassed by the Pension Insurance for Seamen under the primary rules mentioned above under Section 2.1.1. The agreements entail a clear obligation for the National Office for Social Insurance Abroad (FFU) as the Norwegian competent institution to accept correctly issued Polish and Latvian forms for national insurance in the home country. Confirmation must be given on Form E 101 or in a corresponding manner. However, the responsibility for inclusion in the Polish/Latvian national insurance scheme and issue of forms under the agreement rests exclusively with the Polish/Latvian authorities. Reporting of wages and payment of contributions to the Pension Insurance for Seamen shall take place in the normal way in 6 annual terms, with payment falling due on the 20 th of the
month after the expiry of each term. For those entering service at the beginning of the reporting period, this will result in a deadline of 2 months or more for ensuring submission of the necessary confirmation to the FFU concerning national insurance in the home country. We remind you that the shipping company is responsible for employer s contribution for every obligatory member of the national insurance scheme on board and payment of this, and is entitled to deduct this from the wage settlement. Should the shipping company fail to do this, the contribution cannot be claimed from the employee when three months have passed since the wage settlement. The Ministry of Labour and Social Affairs has issued the following guidelines concerning flexibility in connection with the collection of contributions in relation to these agreements: Collection of contributions to the Pension Insurance for Seamen shall be postponed for two calendar months after the month when the seaman from Poland/Latvia began service on an NIS ship, since it is presumed that the seaman must be subject to legislation in the country of residence. This shall be reported to the Pension Insurance for Seamen in the normal way. Should the FFU not receive documentation of national insurance in the home country in the course of the deadline period, collection of contributions for the whole period following entry into service on the ship shall be implemented. Where documentation is submitted after the deadline, the Pension Insurance for Seamen will grant exception with retroactive force, and any pension contributions paid in will be refunded. 3. The new Nordic National Insurance Convention from 1 September 2004 18 August 2003 the Nordic countries (Denmark, Finland, Iceland, Norway and Sweden) signed a new Nordic National Insurance Convention which came into effect 1 September 2004, and which replaced the previous Nordic National Insurance Convention of 15 June 1992. The new Convention is applicable to all legislation encompassed by Council Decree (EEC) No. 1408/71, i.e. also to the Pension Insurance for Seamen. The Convention also authorizes access for the autonomous regions of the Faeroe Islands, Greenland and Åland to be encompassed by the Convention to the extent that these regions have given their consent to this. Persons born in Greenland and the Faeroe Islands are Danish citizens and shall pay contributions to the national insurance scheme. The new Nordic Convention will have independent significance for the Pension Insurance for Seamen beyond the Decree s provisions inasmuch as citizens from non-eu/eea countries who are permanently domiciled in one of the other Nordic countries will come under the Pension Insurance for Seamen when they serve on Norwegian ships (NOR or NIS) which are encompassed by the pension insurance scheme. For example, a Filipino domiciled in Sweden, or a Russian domiciled in Finland, will be encompassed by the Pension Insurance for Seamen when they serve on a Norwegian ship (NOR or NIS) encompassed by the pension insurance scheme. Thus, the shipping company shall make deductions, submit contribution lists and pay in employee s and shipping company s contributions for non-eu/eea citizens domiciled in Denmark, Finland, Iceland and Sweden.
