Fastsatt av Sosialdep. i, Statens Institutt for Strålehygiene skal føre tilsyn etter lov nr. 1 av 18. juni 1938 om bruk av røntgenstråler og radium m. v.
Instituttet bemyndiges til å godkjenne anlegg og apparater osv. 23. som går inn under nevnte lov, jfr. forskriftenes 3, og til å gi særskilte forskrifter og pålegg etter lovens 1 tredje ledd, og forbud etter lovens 4. Uansett om betingelsene for godkjenning for øvrig er til stede, kan godkjenning nektes dersom tilfredsstillende vedlikehold ikke kan påregnes. Det tilsyn m. v. som utføres etter disse forskrifter kommer ikke i stedet for tilsyn m. v. utfort etter andre forskrifter, f. eks. forskrifter for elektriske anlegg. 2 Sosialdepartementet er klageinstans for de avgjorelser instituttet tar i medhold av disse forskrifter. For klagebehandlingen gjelder lov av 10. februar 1967 om behandlingsmåten i forvaltningssaker. 3 Tilsynet m. v. etter 1 gjelder alle anlegg, apparater, materiell c? stoffer som frambringer ioniserende stråling og som brukes i medisinsk, vetcrinært, vitenskapelig, industrielt eller annet oyemed samt alle beholdninger, avfall og utslipp av stoffer som frambringer ioniserende stråling. I tillegg skal tilsynet m. v. etter 1 også omfatte all bruk av laser, radar, mikrobolger og annen helsefarlig elektromagnetisk stråling i henhold til lovens 6 annet ledd. Bestemmelsene i forste ledd om tilsynet gjelder ikke anlegg, apparater, materiell og stoffer som er unntatt etter nærmere bestemmelser av Forsvaret. 4 Anlegg m. v. som går inn under 3 og som allerede er i drift, skal meldes til instituttet når dette krever det. Nye anlegg m. v. og utvidelser eller større forandringer ved eksisterende anlegg m. v. skal meldes til instituttet for arbeidet settes i gang, og må ikke tas i bruk før instituttet har gitt tillatelse til det. Før salg eller bruk av apparater og materiell m. v. finner sted, skal melding gis til instituttet som kan forby salg og bruk for det er godkjent. Instituttet kan i det enkelte tilfelle dispensere fra kravet om meldeplikt. 5 Eier av anlegg, apparater og stoffer m. v. er ansvarlig for at de plikter som pålegges ham etter loven og disse forskrifter blir etterkommet.
1976 28 23. jan. Den som forestår driften av anlegg og apparater m. v. plikter å påse at de ikke brukes i strid med forskrifter eller påbud fra instituttet. Man plikter å melde fra til eieren hvis anlegg eller apparater antas å lide av mangler som kan medføre fare for noens liv eller helbred. Blir manglene ikke rettet, skal han melde fra til instituttet. Eier av anlegg, apparater og stoffer m. v. som er godkjent etter disse forskrifters 1 annet ledd plikter omgående å sende instituttet skriftlig melding om opphør av bruken, nedleggelse av anlegget m. v. Godkjenningen bortfaller når slik melding er registrert i instituttet. 6 Instituttet bemyndiges til å gi særskilte forskrifter om utdannelse for dem som bruker anlegg, apparater og stoffer m. v. som omfattes av forskriftenes 3. 7 For tilsyn og godkjenning skal eier av anlegg m. v. betale en årlig avgift som for hvert enkelt tilfelle er fastsatt i et av Sosialdepartementet godkjent regulativ. I særlige tilfelle kan departementet frita for avgift, heit eller delvis. Drives anlegget m. v. for regning av en annen enn eieren, er han også ansvarlig for betalingen. Avgiften innkreves av instituttet og forfaller 14 dager etter påkrav. Blir avgiften ikke betalt ved forfall, svares deretter morarenter etter den tid til enhver tid gjeldende rentesats for skyldig merverdiavgift. For tilsyn og undersøkelser som instituttet etter anmodning utfører utenom det forutsatte regelmessige tilsyn, betales særskilt godtgjoring etter satser som i tilfelle kan fastsettes av Sosialdepartementet 8 Disse forskrifter trer i kraft straks. # Fra samme tid oppheves forskrifter om tilsyn med røntgenanlegg og radium m. v., gitt ved kgl. res. av 22. oktober 1948. Sosialdepartementet bemyndiges til å gi tillegg til, foreta endringer i ogr oppheve disse forskrifter.
Regulations on the supervision and use of installations, apparatus, material and substances which release ionizing or other radiation representing a danoer to health Issued by Royal Decree of 23 January 1976 pursuant to the Act of 18 Dune 1938 relating to the Use of X-Rays and Radium etc. Laid down by the Ministry of Social Affairs. 1 The State Institute of Radiation Hygiene shall exercise supervision in accordance with Act no 1 of 18 June 1938 relating to the Use of X-Rays and Radium etc. The Institute is empowered to authorize installations and apparatus etc. covered by the said Act, cf. 3 of the Regulations, and to issue special regulations and instructions in accordance with the third paragraph in 1 of the Act, as well as prohibitions in accordance with 4 of the Act. Regardless of whether the conditions required for authorization obtain in other respects, authorization may be refused if satisfactory maintenance cannot be counted upon. Such supervision etc. as is carried out in accordance with these Regulations does not take the place of supervision etc. carried out in accordance with other regulations, for example regulations in respect of electrical installations. 2 ThB Ministry of Social Affairs is the appellate instance for the decisions the Institute takes pursuant to these Regulations. The Act of 10 February 1967 relating to the Procedure in Administrative Cases (short title: The Public Administration Act) is applicable in respect of the appeals procedure. 3 The supervision etc. pursuant to 1 applies to all
installations, apparatus, material and substances which produce ionizing radiation and which are used for medical, veterinary, scientific, industrial or other purposes, as u/ell as stocks, waste and discharge of substances which produce ionizing radiation. In addition, the supervision etc. pursuant to 1 shall also include all use of lasers, radar, microwaves and other electromagnetic radiation representing a danger to health, in pursuance of the second paragraph of 6 of the Act. The provisions in the first paragraph regarding supervision do not apply to installations, apparatus, material and substances which are excepted pursuant to specific provisions by the Defence establishment. 4 Installations etc. which are covered by 3 and which are already in operation shall be notified to the Institute if it so requires. Neu; installations etc. and extensions or major alterations etc. shall be notified to the Instituts before the work is commenced, and must not be taken into use before the Institute has given its permission. Before the sale or use of apparatus or material etc. may be effected, notification shall be given to the Institute which may prohibit sale or use before authorization has been granted. In individual cases, the Institute may grant dispensation from the notification requirement. 5 The owner of an installation, apparatus and substances etc. is responsible for seeing that the obligations incumbent on him pursuant to the Act and these Regulations are observed. Any person in charge of the operation of an installa- - tion and apparatus etc. shall be under an obligation to see that these are not used contrary to the regulations or instructions from the Institute. It is compulsory to notify the owner if installations or apparatus may be considered to have defects which can endanger life or health. If such
defects are not rectified, the Institute shall bß notified. The owner of an installation, apparatus and substances etc. mho is authorized in accordance with the second paragraph of 1 of these Regulations is under an obligation to notify the Institute immediately in writing upon discontinuance of such use, the closing dou/n öf the installation etc. The authorization lapses when such notification is registered in the Institute. 6 The Institute is empowered to issue special regulations concerning training for those u/ho use installations, apparatus and substances etc. covered by 3 of the Regulations. 7 For supervision and authorization, the owner of an installation etc. shall pay an annual fee which for each individual case is laid down in a scale of fees approved by the Ministry of Social Affairs. In special cases the Ministry may waive the fee, in whole or in part. If the installation etc. is operated for the account of a person other than the owner, such a person is likewise responsible for payment of the fee. The fee is collected by the Institute and falls due 14 days after demand for payment. If the fee has not been paid by the due date, interest on the overdue fee shall be subsequently paid at the applicable rate of interest for value-added tax in arrears. For supervision and investigations carried out on request by the Institute over and above the required regular supervision, a special remuneration shall be paid at the rates which in the relevant case may be determined by the Ministry of Social Affairs. 8 These Regulations shall enter into force immediately.
From the same date, the regulations regarding the supcruibinn of X-Ray installations and radium etc., laid doum in 1 the Royal Decree of 22 October 1948, are repealed, / The Ministry of Social Affairs is empowered to supplement, amend and repeal these Regulations.
