Chapter-1 PRELIMINARY 1. Short title extent & commencement. (1) These Rules may be called as the Bihar Employees State Insurance Scheme Dresser (Recruitment, Promotion and Service conditions) Cadre Rules, 2016 (2) It shall extend to the whole of the state of Bihar. (3) It shall come into force at once. 2. Definitions. In these Rules, unless otherwise requires in the subject or context :- (i) Government means the Government of Bihar; (ii) Department means the Labour Resources Department; (iii) Commission means the Bihar Staff Selection Commission; (iv) Appointing Authority means Director, Medical Services, Employees State Insurance Scheme, Bihar; (v) Cadre means the Bihar Employees State Insurance Scheme Dresser Cadre ; and (vi) Appendix means appendix appended to these Rules; (vii) 'Cadre controlling Authority means Director, Medical Services, Employees State Insurance Scheme, Bihar. 3. Constitution of Cadre. The Cadre of Dresser shall be at State level. In this cadre, number of posts in every grade, and total number of posts of the cadre shall be the same as sanctioned by the Government, from time to time. 4. Hierarchy of posts of cadre. Different grades and hierarchy of posts of this cadre shall be according to Appendix-1. The personals having regular appointment and working on the posts of this cadre prior to coming into force of these Rules, shall be deemed to be automatically included in this cadre. The hierarchy mentioned in the Annexure shall be effective only after approval of the Government. If during course of consideration any amendment is made in the hierarchy of post if this cadre, then the Annexure would be deemed to be amended accordingly, and the amended Annexure shall be part of this Rules.

बह र गजट [स ध रण 7 अ त बर 2016 Chapter-2 RECRUITMENT 5. Recruitment. The Appointment in this Cadre shall be by direct recruitment to the basic grade (Dresser) post, on the basis of recommendation of the commission. 6. Qualifications. (1) For appointment to the basic grade posts by direct recruitment, minimum educational qualification shall be pass in Matric /10 th (with physics, chemistry, Biology and English). In addition to this, pass in certificate course from a government recognized institution and a Dresser certificate related thereto shall be necessary. (2) For direct recruitment in the Dresser Cadre, minimum age limit shall be 18 years and maximum age limit shall be the same as may be determined reservation category wise, from time to time, by the Government. 1 st August of the concerned year shall be deemed to be the cut off date for determination of age. 7. Procedure of recruitment. (1) The appointing authority, after calculating vacancy on the basis of position as on 1 st April of the year and getting roster cleared, shall send reservation category wise requisition to the Bihar Staff Selection Commission latest by 30 th April. (2) In light of requisition, the Commission shall invite applications after advertising vacancies and shall select candidates on the basis of written primarily competitive Examination. (i) For marks obtained in Matric/10 th examination - 30 Marks (ii) For marks obtained in higher degree - 15 Marks (iii) For certificate Course examination - 30 Marks (iv) For work experience in government hospital of Bihar State (5 marks for per year, maximum 30 marks) - 25 Marks Total 5-100 Marks Note The marks to be given to a candidate for marks obtained in Matric/10 th and Certificate course Examination shall be determined by multiplying the percentage of total marks obtained in the examination of the said courses respectively by multiple of 0.25 and 0.35. For example, if a candidate has obtained 50 % marks in Matric he will be given 50 X 0.25=12 1 /2 marks, similarly, if he obtains 50% marks in Certificate course Examination, he will be given 50 X 0.35=17 1 /2 marks. (3) The Commission shall prepare a merit list as per above criteria. After preparation of merit list, preliminary scrutiny of certificates and medical tests shall cause to be conducted by the commission with the cooperation of the Appointing Authority and thereafter reservation category wise final recommendation, in accordance with the requisitioned vacancies, shall be sent to the Appointing Authority. At the level of Appointing Authority also, the antecedents of recommended candidates shall cause to be verified after scrutiny of certificates. (4) Compliance of instructions issued by the Government, from time to time, with respect to procedure of appointment, after recommendation of the Commission, shall be necessary.

6 बह र गजट [स ध रण 7 अ त बर 2016 Chapter-3 PROBATION/DEPARTMENTAL EXAMINATION/CONFIRMATION 8. Probation period. After appointment the candidates shall be on probation. The probation period shall be of two years. In case Service during probation period is not found satisfactory and if Appointing Authority satisfied that there is chance of improving, the probation period shall be extended for one year. If the service is not found satisfactory in the extended period also, then the Appointing Authority may terminate the service of such Dresser. 9. Training. In probation period the probationer Dresser shall have to complete such training successfully as may be prescribed by the Department. 10. Departmental examination. The Dresser shall have to pass the Departmental Examination held by the Department. The syllabus of Departmental Examination will be determined by the Department. 11. Confirmation. After having satisfactory service in probation period, successful completion of training and passing the Departmental Examination, a Dresser may be confirmed in the service. Percentage of passing of Departmental examination will be 40% 12. Seniority. The inter-se seniority of Dresser shall be determined according to the merit list prepared finally by the Commission. Chapter-4 PROMOTION 13. Hierarchy of Promotion. (1) Consideration would be made to promote a Dresser to the promotional post as mentioned in Appendix-1, whose services are confirmed, and who come under the zone of promotion on the basis of seniority cum- eligibility subject to availability of post. (2) For promotion, Compliance of instructions regarding KALAWADHI determined by the Government, from time to time, shall be necessary. (3) It shall be required to comply instructions issued by the Government, from time to time, with respect to promotion, and character Roll/PAR, allegations/departmental proceedings/criminal proceedings, etc at the time of consideration of promotion. 14. Departmental Promotion. Promotions shall be on the basis of recommendations of the Departmental Promotion Committee. The Departmental Promotion Committee shall be constituted by the Department. Chapter 5 MISCELLANEOUS 15. Reservation. It shall be essential to comply the provisions of the Reservation Act of the Government and reservation roster for direct recruitment as well as promotion, issued by the Government from time to time. 16. Residual Matters. The provisions of relevant Codes/ Rules/ Resolutions/ Instructions of the Government shall apply to such subjects for which no provision is made in these Rules. 17. Removal of doubts. If any doubt arises with respect to implementation of any provision of these Rules, it shall be referred to the Department and in this respect decision of the Department after consultation with Law Department shall be final. 18. Removal of difficulties. If any difficulty arises in interpretation of provisions of these Rules, the Department may remove such difficulty after consultation with the General Administration Department and the Law Department by general or special order.

(1) The Rules, and all resolutions, orders, instructions etc. issued earlier, from time to time, by the Department with respect to this cadre, are here by repealed. (2) Notwithstanding such repeal, any thing done or any action taken under aforesaid Rules, Resolution, Instruction, Orders, etc, shall be deemed to be done or taken under these Rules, as if these Rules were in force on the date on which such a work was done or such an action was taken.
