Only those tenderers were included in the negotiations which have satisfied the qualitative selection criteria: no Other justification for the award of the contract without prior publication of a contract notice in the OJEU The contract falls outside the scope of application of the Directive The contract is exempt from the regulations in accordance with FOA 1.3 a) last alternative 'considerable security interests'. A competition in accordance with the LOA is not possible. The procurement is regardless exempt from a publication obligations in accordance with FOA 14-4 letter c ('technical reasons' and 'protection of sole rights'). In this case DSB entered into a contract in 2009 for the system that last for four years. Changing the system involves a risk. Due to the critical character of the system, system changes ought to be carried out as seldom as possibe. Financially, it would be a waste of resources to change the system at the current time (due to change costs). There is also another locking effect for this case as the entities that use DSB's contract (including DSB) ought to use the same system as the Ministries. It is not technically impossible to use two different systems, but having integration between two different systems at this level is seen to be very unfortunate based on a risk perspective. In principle DSB could announce a competition for the procurement of new licences and continued maintenance of the CIM system. In order for there to be any point for this, there must be a competition at dealer level. Such a competition does not exist.
