KOMMISJONENS GJENNOMFØRINGSFORORDNING (EU) nr. 451/2012 av 29. mai 2012 om tilbaketrekking frå marknaden av visse tilsetjingsstoff i fôrvarer som tilhøyrer den funksjonelle gruppa «tilsetjingsstoff til ensilasje» EUROPAKOMMISJONEN HAR med tilvising til traktaten om verkemåten til Den europeiske unionen, med tilvising til europaparlaments- og rådsforordning (EF) nr. 1831/2003 av 22. september 2003 om tilsetningsstoffer i fôrvarer( 1 ), særleg artikkel 10 nr. 5, og ut frå desse synsmåtane: 1) Forordning (EF) nr. 1831/2003 inneheld føresegner om godkjenning av tilsetjingsstoff i fôrvarer og om vilkår og framgangsmåtar for å gje slik godkjenning. I artikkel 10 nr. 7 i forordning (EF) nr. 1831/2003 jamførd med artikkel 10 nr. 1-4 i den nemnde forordninga er det fastsett særlege føresegner om vurdering av produkt som vert nytta i Unionen som tilsetjingsstoff til ensilasje på datoen då den nemnde forordninga tok til å gjelde. 2) Dei tilsetjingsstoffa i fôrvarer som er førde opp i vedlegget, vart førde opp i fellesskapsregisteret over tilsetjingsstoff i fôrvarer som eksisterande produkt, i samsvar med artikkel 10 nr. 1 i forordning (EF) nr. 1831/2003. 3) Med omsyn til bruken av desse tilsetjingsstoffa som tilsetjingsstoff til ensilasje, vart det ikkje send inn nokon søknad om godkjenning i samsvar med artikkel 10 nr. 7 jamførd med artikkel 10 nr. 2 i forordning (EF) nr. 1831/2003 innan fristen som er fastsett i artikkel 10 nr. 7. Med omsyn til tilsetjingsstoffet heksametylentetramin vart det for visse dyreartar ikkje send inn søknad om godkjenning innan den fristen. 4) Av omsyn til klarleiken vart dei tilsetjingsstoffa som det ikkje er send inn søknad om godkjenning for innan det tidsrommet som er nemnd i artikkel 10 nr. 7 i forordning (EF) nr. 1831/2003, førde opp i ein separat del av fellesskapsregisteret over tilsetjingsstoff i fôrvarer. 5) Desse tilsetjingsstoffa bør difor trekkjast tilbake frå marknaden med omsyn til bruk som tilsetjingsstoff til ensilasje, bortsett frå for artar som det er send inn søknad om godkjenning for. Dette tiltaket rører ikkje ved bruken av somme av dei tilsetjingsstoffa som er nemnde ovanfor, i samband med andre kategoriar eller funksjonelle grupper som dei er godkjende for. 6) Ettersom tilbaketrekkinga av dei aktuelle tilsetjingsstoffa til ensilasje ikkje vert gjord av tryggleiksgrunnar, bør det tillatast ein overgangsperiode der eksisterande lager med desse tilsetjingsstoffa i tillegg til premiksar og ensilasje som er framstilte med desse tilsetjingsstoffa, kan brukast opp. 7) Tilbaketrekkinga av dei tilsetjingsstoffa som er førde opp i vedlegget, bør ikkje hindre ei mogleg framtidig godkjenning av dei eller innføring av tiltak med omsyn til statusen deira på grunnlag av og i samsvar med dei framgangsmåtane som er fastsette i forordning (EF) nr. 1831/2003. 8) Dei tiltaka som er fastsette i denne forordninga, er i samsvar med fråsegna frå Det faste utvalet for næringsmiddelkjeda og dyrehelsa ( 1 ) TEU L 268 av 18.10.2003, s. 29.
2 VEDTEKE DENNE FORORDNINGA: Artikkel 1 Tilbaketrekking Dei tilsetjingsstoffa som er førde opp i del A i vedlegget, og som tilhøyrer den funksjonelle gruppa «tilsetjingsstoff til ensilasje» i kategorien «teknologiske tilsetjingsstoff», skal trekkjast tilbake frå marknaden. Det tilsetjingsstoffet som er ført opp i del B i vedlegget, og som tilhøyrer den funksjonelle gruppa «tilsetjingsstoff til ensilasje» i kategorien «teknologiske tilsetjingsstoff», skal trekkjast tilbake frå marknaden for dei dyreartane som er nemnde i den delen av vedlegget. Artikkel 2 Overgangstiltak 1. Eksisterande lager av dei tilsetjingsstoffa som er førde opp i del A i vedlegget, kan framleis bringast i omsetning og nyttast som tilsetjingsstoff i fôrvarer som tilhøyrer den funksjonelle gruppa «tilsetjingsstoff til ensilasje» i kategorien «teknologiske tilsetjingsstoff», fram til 19. juni 2013. 2. Premiksar som er framstilte med dei tilsetjingsstoffa som er nemnde i nr. 1, kan framleis bringast i omsetning og nyttast fram til 19. juni 2013. 3. Ensilasje som er framstilt med dei tilsetjingsstoffa som er nemnde i nr. 1, eller med dei premiksane som er nemnde i nr. 2, kan framleis bringast i omsetning og nyttast fram til 19. juni 2014. 4. Med omsyn til det tilsetjingsstoffet som er ført opp i del B i vedlegget, skal nr. 1, 2 og 3 nyttast på dei dyreartane som er nemnde i den delen av vedlegget. Artikkel 3 Iverksetjing Denne forordninga tek til å gjelde 20. dagen etter at ho er kunngjord i Tidend for Den europeiske unionen.
