Innledning Forskrift om forebyggelse av anslag mot sikkerheten i luftfarten mv. (BSL SEC 1-1) trådte i kraft mars Forskriften gjennomfører blant annet en rekke forordninger og beslutninger i henhold til E0S-avtalen på securityområdet, jf. forskriften 3. Regelverkspakken på securityområdet har blitt supplert med ytterligere fem kommisjonsforordninger og to kommisjonsbeslutninger. Høring av detaljerte gjennomføringsbestemmelser Følgende EU-regelverk er per i dag vedtatt i EU, men ikke gjennomført i norsk rett: Kommisjonsforordning (EU) nr. 983/2010 av 3. november 2010 som endrer forordning (EU) nr. 185/2010 om fastsettelse av detaljerte tiltak for gjennomføring av felles grunnleggende standarder for luftfartssikkehet, så langt det gjelder godkjennelse av sikkerhetsnivået i USA. Kommisjonsforordning (EU) nr. 859/2011 av 25. august 2011 som endrer forordning (EU) nr. 185/2010 om fastsettelse av detaljerte tiltak for gjennomføring av felles grunnleggende standarder fou lurtfutsikkellet, sli langt og pa til EU f a Kommisjonsbeslutning 2011/5862/EU av 17. august 2011 som endrer kommisjonsbeslutning 2010/774/EU som fastsetter detaljerte gjennomføringsbestemmelser i tilknytning til de felles bestemmelser om sikkerhet i sivil luftfart, så langt det gjelder frakt og post til EU fra tredjeland (hemmelig del). Kommisjonsforordning (EU) nr. 1087/2011 av 27. oktober 2011 som endrer forordning (EU) nr. 185/2010 om fastsettelse av detaljerte tiltak for gjennomføring av felles grunnleggende standarder for luftfartssikkehet, så langt det gjelder systemer for påvisning av sprengstoffer (EDS). Kommisjonsforordning (EU) nr. 1141/2011 av 10. november 2011 som endrer kommisjonsforordning (EF) nr. 272/2009 om utfylling av de felles grunnleggende standardene for sikkerhet i sivil luftfart, så langt det gjelder bruk av kroppsskannere ("security scanners") securityskannere på lufthavner i EU. Kommisjonsforordning (EU) nr. 1147/2011 av 11. november 2011 som endrer forordning (EU) nr. 185/2010 om fastsettelse av detaljerte tiltak for gjennomføring av felles grunnleggende standarder for luftfartssikkehet, så langt det gjelder bruk av kroppsskannere ("security scanners") på lufthaver i EU.

3 Luftfartstilsynet / Civil Aviation Authority - Norway Komrnisjonsbeslutning 2011/8042/EU av 14. november 2011 som endrer kommisjonsbeslutning 2010/774/EU som fastsetter detaljerte gjennomføringsbestemmelser i tilknytning til de felles bestemmelser om sikkerhet i sivil luftfart, så langt det gjelder bruk av kroppsskannere ("security scanners") på lufthaver i EU (hemmelig del). Intensjonen med høringen av ovennevnte EU-regelverk er å få innspill på eventuelle økonomiske og administrative konsekvenser som de detaljerte gjennomføringsbestemmelsene antas å få. Det materielle innholdet kan gjerne kommenteres, men det er ikke mulig å gjøre noen endringer i dette. Regelverket foreligger per i dag ikke på norsk. Det er engelsk versjon av forordningene som publiseres. 2.1 Regelverkets innhold Godkjennelse av sikkerhetsnivået i USA I fortalen til forordning (EU) nr. 983/2010 er det vist til at Kommisjonen kan anerkjenne at et tredjelands sikkerhetsstandard innen sivil luftfart tilsvarer sikkerhetsstandarden innen EU. Forutsetningen for en slik anerkjenne1se er at kriteriene i kommisjonsforordning (EF) nr. 272/2009 kapittel E er oppfylt. Forordning (EU) nr. 983/2010 endrer forordning (EU) nr. 185/2010 om detaljerte bestemmelser om sikkerhet i sivil luftfart slik at sikkerhetsstandarden i USA blir godkjent med hensyn til luftfartøyer, passasjerer, håndbagasje og innsjekket bagasje. Dette innebærer at passasjerer som kommer fra USA og skal videre innen EU som hovedregel slipper å gå gjennom en ny sikkerhetskontroll. Forordningen innebærer at passasjerer som reiser fra USA til Europa blir en del av one-stop security regimet innen EU. Det vil si at en passasjer som reiser fra en amerikansk lufthavn til en europeisk lufthavn, ikke lenger blir sikkerhetskontrollert når vedkommende lander på en europeisk lufthavn og skal reise videre innen EU. Forordningen innebærer ikke at USA åpner for one-stop security for europeiske flypassasjerer som skal reise fra Europa til USA. Forslaget medfører således ingen resiprositet fra USA overfor EU-statene. I forordningen er det tatt inn et krav om at Kommisjonen uten opphold skal varsle de nasjonale myndigheter med ansvar for sivil luftfart dersom Kommisjonen har informasjon om at tredjelandet ikke lenger oppfyller sikkerhetsstandardene i de felles europeiske bestemmelser om sikkerhet i sivil luitfart. idere skal Kommisjonen varsle nevnte myndighet med en gang dersom de har palitelig informasjon om tiltak som tredje1andet har gjennomført for å gjenopprette sikkerhetsstandarden, inkludert kompenserende tiltak. Økonomiske o administrative konsekvenser Norge har direkteflygninger fra USA til Oslo lufthavn, Gardermoen. På grunn av tollbehandlingen vil forordningen foreløpig ikke få stor praktisk betydning for passasjerer som ankommer fra USA til Norge. Alle som ankommer Oslo lufthavn, Gardermoen, må ta ut sin bagasje og gå igjennom tollsystemet. Passasjeren må deretter sjekke inn bagasjen og gå igjennom sikkerhetskontrollen på nytt hvis de skal reise videre innenlands Frakt og post til EU fra tredjeland For å beskytte den delen av sivil luftfart som transporterer frakt og post til EU fra tredjeland, er det i forordning (EU) nr. 859/2011 og tilhørende beslutning 2011/5862/EU fastsatt nærmere bestemmelser om dette. Når det gjelder det nærmere innholdet i beslutningen, vil det ikke bli gjort rede for da vedlegget til beslutningen er hemmelig som nevnt innledningsvis. Side 2 av 5

4 Luftfartstilsynet / Civil Aviation Authority - Norway For å beskytte frakt og post til EU fra tredjeland har det blant annet blitt fastsatt detaljerte bestemmelser i forordning (EU) nr. 859/2011 vedleggets punkt 6.8. For frakt fra tredjeland som ikke står på listen i forordningens vedlegg 6-F må det utpekes en "Air Cargo or Mail Carrier operating into the Union from a Third Country Airport" (ACC3). I vedleggets punkt er det fastsatt to tidsfaser med hensyn til ACC3: Fase 1 gjelder fra I. februar 2012 til 30. juni 2014 og innebærer at flyselskap som flyr frakt og/eller post inn til EU/EØS fra tredjeland som ikke står på listen i vedlegg 6-F må utpekes som ACC3. For EU-flyselskap skal søknad om ACC3-status sendes til vedkommende myndighet i det landet flyselskapet er registrert (se mer om dette i vedlegget punkt a)). Det innebærer at flyselskap med norsk AOC skal søke Luftfartstilsynet om godkjenning. De nærmere vilkårene for å oppnå ACC3-status er gitt i forordning 859/2011 vedleggets punkt punkt Blant annet må flyselskapene avgi en erklæring ("declaration of committments"), jf. vedlegg 6-G, samt forsikre at sikkerhetsprogrammet deres dekker kravene i forordningens vedlegg 6-G for å oppnå ACC3-status. Fase 2 gjelder fra 1. juli 2014 og fra dette tidspunktet skal ACC3, i tillegg til ovennevnte krav, blant annet sikre at sikkerhetsgodkjente fraktleverandører og kjente avsendere i tredjeland er blitt uavhengig godkjent ("independently validated"). De detaljerte vilkårene finnes i vedleggets punkt og Videre er det i vedlegget også gitt bestemmelser om hvordan frakt og post fra tredjeland skal sikkerhetskontrolleres (punkt 6.8.2), utpeking av tredjelands sikkerhetsgodkjente fraktleverandører, kjente avsendere og registrerte avsendere (punkt 6.8.3), samt krav til innholdet i sikkerhetsprogrammet til ACC3 (vedlegg 6-G). Forordningen og beslutningen trer i kraft i EU I. februar Økonomiske o administrative konsekvenser Regelverket innebærer konsekvenser primært for følgende aktører: Luftfartsselskaper som ska1 fly frakt og post til EU/EØS fra lufthavner i enkelte tredjeland må ha ACC3-status. Fraktleverandører som mottar frakt og/eller post fra tredjeland må undersøke om lultlartselskapet har eller ikke trenger status som ACC3, før frakten/posten sendes videre. Luftfartstilsynet får utvidede oppgaver ved at ACC3-luftfartsselskaper som flyr frakt og post fra tredjeland til Norge må følges opp, herunder adgangskontroll og virksomhetstilsyn, men omfanget antas å bli relativt begrenset. Lufthavnene i Norge mottar begrenset volum av frakt og post fra tredjeland, og det antas således at konsevensene for lufthavnene som følge av regelverket ikke blir av stort omfang Systemer for påvisning av sprengstoffer (EDS). Forordning (EU) nr. 1087/2011 endrer forordning (EU) nr. 185/2010 vedleggets punkt I tillegg til ny nummerering av de eksisterende underpunktene i vedleggets punkt 12.4, er det gjort følgende materielle endringer i bestemmelsen; Punkt er endret - EDS standard 2 utløper 1. september Dette innebærer at utløpsfristen er forlenget med to år fra I. september Side 3 av 5

5 Luftfartstilsynet / Civil Aviation Authority - Norway Nytt punkt åpner for at vedkommende myndighet (i Norge er dette Luftfartstilsynet) på nærmere vilkår kan tillate fortsatt bruk av EDS standard 2 til 1. september Vilkåret er at EDS standard 2 ble installert i perioden 1. januar september Nytt punkt Det er krav om at EFTAs overvåkingsorgan (ESA) må informeres dersom bestemmelsen i punkt blir benyttet etter 1. september Punkt er endret - EDS installert etter 1. september 2014 skal være standard 3. Dette innebærer at kravet om at utsyret må holde standard 3 er utsatt med 2 år, fra 1. september 2012 til 1. september Endring av og ny bestemmelse i punkt Det er krav om at standard 3 skal gjelde for all EDS senest innen 1. september 2020, såfremt vedkommende myndighet (Luftfartstilsynet) ikke har benyttet muligheten til å forlenge bruken av EDS standard 2, jf. punkt Endringen innebærer at fristen for å innføre standard 3 forlenges fra 1. september 2018 til 1. september I tillegg er det åpnet for at de landene som har anvendt bestemmelsen i punkt , kan benytte EDS standard 2 til I. september konomiske o administrative konsekvenser Slik Luftfartstilsynet ser det medfører forordningen ingen endringer i de administrative og økonomiske konsekvensene for aktørerene, da forordningen i prinsippet bare utsetter innføringen av ny teknologi, herunder standard 3, som allerede er gjennomført i forordning (EU) nr. 185/ Bruk av kroppsskannere ("security scanners") på lufthavner i EU I gjeldende regelverk er det bestemt at følgende metoder for sjekk av passasjerer, alene eller i kombinasjon, er tillatt; manuell gjennomsøking, metalldetektorportal, håndholdt metalldetektor, bombehund samt utstyr for sporpåvisning av eksplosiver (ETD). Forordning (EU) nr. 1141/2011, forordning (EU) nr. 1147/2011 og tilhørende beslutning 2011/8042/EU åpner for at man i tillegg til de ovennevnte alternativene, skal kunne benytte kroppsskannere som metode for sjekk av passasjerer på lufthavner i EU. Forordningen gir nærmere bestemmelser om hvilke krav som skal følges ved bruk av kroppsskanner. Når det benyttes en kroppsskanner skal følgende minimumskrav følges: Kroppsskanneren må ikke lagre, oppbevare, kopiere, skrive ut eller hente bilder. Ethvert bilde som lages under prosessen kan dog beholdes i den tid det tar for operatøren å analysere det. Bildet slettes så snart passasjeren er klarert. Uvedkommendes adgang til og anvendelse av bildet er forbudt og skal forhindres. Den operatøren som analyserer bildet skal befinne seg i et annet lokale, slik at vedkommende ikke kan se passasjeren som sjekkes. Det er forbudt å medbringe enhver form for teknisk anordning som kan lagre, kopiere, fotografere eller på annen måte registrere bilder, inn i det lokalet der det skannede bildet analyseres. Bildet må ikke knyttes sammen med opplysninger om den skannede personen, og vedkommende skal forbli anonym, En passasjer kan be om at bildet analyseres av en operatør av et bestemt kjønn. Bildet skal være uklart slik at det ikke er mulig å identifisere passasjerens ansikt. En passasjer har rett til å avstå fra sjekk med kroppsskanner. I så tilfelle benyttes alternative sjekkmetoder, herunder minst en manuell gjennomsøking. Side 4 av 5

6 Luftfartstilsynet / Civil Aviation Authority - Norway Før en passasjer sjekkes ved hjelp av en kroppsskanner skal vedkommende informeres om den teknologi som benyttes, betingelsene for bruk av angjeldende teknologi og muligheten til å avstå fra sjekk med kroppsskanner. I regelverket er det også gitt bestemmelser om sertifisering av de personene som skal utføre sjekk av passasjerene med kroppsskanneren. Videre er det foreslått at kroppsskanneren skal oppfylle følgende krav: kroppsskanneren skal som et minimum være i stand til å detektere og ved hjelp av en alarm avsløre nærmere angitte metalliske og ikke-metalliske gjenstander, herunder sprengstoff, både enkeltvis og i kombinasjon med hverandre deteksjonen skal kunne foretas uansett hvor gjenstanden befinner seg, og hvordan den vender systemet skal være forsynt med en visuell indikator som viser at utstyret er i drift kroppsskannere plasseres således at det sikres at de ikke påvirkes av interferenskilder det skal daglig testes at securityscanneren fungerer korrekt securityscanneren skal anvendes i overensstemmelse med de driftsbetingelser som stilles av produsenten. Det er i tillegg fastsatt detaljerte bestemmelser om bruk av kroppsskannere i den delen av regelverket som er hemmelig. Økonomiske o administrative konsekvenser Når det gjelder eventuelle økonomiske og administrative konsekvenser vil det påløpe kostnader for de lufthavnene som velger å bruke dette alternativet ved sjekk av passasjerene. Bruk av kroppsskanner er ikke påbudt. Gjennomføring i norsk rett Når regleverket er besluttet innlemmet i EØS-avtalen, vil ovennevnte forordninger og beslutninger bli gjennomført i norsk rett ved endring av forskrift om forebyggelse av anslag mot sikkerheten i luftfarten mv. 3. 12 EN Official Journal of the European UnionI. 220/9 COMMISSION IMPLEMENTING REGULATION (EU) No 859/2011 of 25 August 2011 on amending Regulation (EU) No laying down detailed measures for the implementation of the common basic standards on aviation security in respect of air cargo and mail (Text with EEA relevance) THE EUROPEAN COMMISSION, Having regard to the Treaty on the Eunctioning of the European Union, Having regard to Regulation (EC) No 300/2008 of the European Parliament and the Council of 11 March 2008 on common rules in the field of civil aviation security and repealing Regulation (EC) No 2320/2002 (') and in particular Article 4(3) thereof, Whereas: they directly accept consignments, and make any adjustments to the system, including amendments to this Regulation, where necessary. Building on the International Civil Aviation Organisation (ICAO) contracting states' responsibility to meet at least ICAO standards for cargo security, the Commission and the Member States should reach out to authorities in third countries to cooperate with and, where possible and requested, provide assistance with capacity building in relation to the implementation of requirements to secure air cargo and mail being carried into the EU. Commission Regulation (EU) No 185/2010 of 4 March 2010 laying down detailed mcasures for the implementation of the common basic standards on aviation security (2) does not contain rules for cargo and mail being carried to Union airports from third countries. It is necessary to introduce such rulcs in order to protect civil aviation carrying such cargo from acts of unlawful interference. The Commission will coordinate and take an active part in Union action for facilitating the implementation of aviation security requirements in respect of operations into the Union from third country airports and provide non-eu bodies with access to relevant information on a strict need to know basis and on the condition that sufficient guarantees arc in place. Regulation (EU) No 185/2010 should thereforc bc amended accordingly. When assessing aviation security in third countries, consideration will bc given to cooperation and partnership agreements concluded between the Union or individual Member States and third countries that provide a basis lor guaranteeing the proper implementation of aviation seeurity standards. When concluding Air Transport Agreements with third countries, the Commission and Member States should work towards achieving enhanced cooperation on aviation security supporting the implementation and application of standards and principles in third countries equivalent to those of the Union where this is effective to mect global threat and risk. By July 2013 the Commission should, together with Member States and stakeholders, examine the practical consequences and feasibility of the implementation of independent validation for air carricrs carrying cargo from third country airports into the EU and the regulated agents and known consignors from which (') OJ L 97, , p. 72. The measures provided for in this Regulation are in accordance with the opinion of the Committee on Civil Aviation Security set up by Article 19(1) of Regulation (EC) No 300/2008, HAS ADOPTED THIS REGULATION: Article 1 The Annex to Regulation (EU) No 185/2010 is amended in accordance with the Annex to this Regulation. Article 2 The Commission will assess and evaluate the application of the measures provided for in this Regulation and if appropriate make a proposal by 1 July 2015 at the latest. The Commission will, at the latest by 31 December 2012, assess the likely impact of the requirements set out in this Regulation, in particular the independent validation requirements. The results shall be submitted to the Committee on Civil Aviation Security. Where appropriate, the Commission will propose adjustments to the requirements by 1 July 2013.

Point is replaced by the following: Where there is any reason to believe that a consignment to which security controls have been apphed has been tampered with or has not been protected from unauthorised interference from the time that those controls were applied, it shall be screened by a regulated agent before being loaded on to an aircraft, Consignments which appear to have been significantly tampered with or which are otherwise suspect shall be treated as high risk cargo or mail (HRCM) in accordance with point 6.7.' Point (d) is replaced by the following: '(d) the security status of the consignment, stating: "SPX", meaning sccure for passenger, all-cargo and all-mail aircraft, or "SCO", meaning secure for all-cargo and all-mail aircraft only: or "SHR" meaning secure for passenger, all-cargo and all-mail aircraft in accordance with high risk requirements.' C. In Chapter 6, the following points are added: 6.7. HIGH RISK CARGO AND MAIL (HRCM) Provisions for high risk cargo and mail are laid down in a separate Commission Decision PROTECTION OE CARGO AND MAIL BEING CARRIED INTO THE UNION FROM THIRD COUNTRIES Designation of air carriers Requirements until 30 )une 2014: (a) any air carrier carrying cargo or mail from an airport in a third country not listed in Attachment 6-F for transfer, transit or unloading at any airport falling within the scope of Regulation (EC) No 300/2008 shall be designated as an "Air Cargo or Mail Carrier operating into the Union from a Third Country Airport" (ACC 3):, t, No 394/2011 (*) amending Regulation (FC) No 748/2009 (**) on thc list of aircraft operators that performed an ayiation activity listed in Annex I to Directive 2003/87/EC of the Europcan Parliament and of the Council (***), by the appropriate authority of the Member State that issued the air carrier's Operator's Certificate for air carriers not listed in the Annex to Regulation (EU) No 394/2011, by the appropriate authority of the Member State where the air carrier has its major base of operations within the Union, or any other appropriate authority of the Union by agreement with that appropriatc authority, for air carriers not listed in the Annex to Regulation (EU) No and not holding an Air Operator's Certificate issued by a Member State; (b) in order to be designated as an ACC3, the carrier shall: ensure that its security programme covers all points listed in Attachment 6- G in respect of cargo and mail being loaded on to its aircraft at any third country airport for carriage into the Union, and submit a "Declaration of commitments ACC3" as set out in Attachment 6-H to the appropriate authority concerned. This declaration shall be signed by the carrier's legal representative or by the person responsible for security, and

15 L 220/12 EN Official Journal of tbe European Union nominate a person to have overall responsibility for implementation of cargo or mail security pruvisloas thiri its hdo,1r and prot, d det3iis of this person to the ipproprioe authority concerned; either the original or a copy of the signed "Declaration of commitments ACC3" shall be retained by the appropriate authority concerned. Where the original is retained by the air carrier it shall be available for inspcction at least during its period of validity; the appropriate authority concerned shall communicate the necessary details of the carrier to the Commission which shall make them available to all Member States. an ACC3 notified to the Commission in accordance with point (d) shall be recognised in all Member States for all operations from the specified third country airport into the Union Requirements to be fulfilled by 1 July 2014: in addition to the requirements set out in point (b), by 1 July 2014 at the latest, the air carrier shall ensure that an on-site verification of its cargo and mail operations at the relevant third country airport has been carried out by an indcpendent validator; the independent validator shall examine the air carrier's security programme and ensure that it covers all the points set out in Attachment 6-G, verify compliance with the programme at the third country airport by using the checklist in Attachment 6-C3 and submit a report: to the appropriate authority of the Member State listed in the Annex to Regulation (EU) No 394/2011 amending Regulation (EC) No 748/2009 on the list of aircraft operators that performed an aviation activity listed in Annex I to Directive 2003/87/EC, to the appropriate authority of the Member State that issued the air carrier's Operator's Certificate for air carriers not listed in the Annex to Regulation (EU) No 394/2011, to the appropriate authority of the Member State where the air carrier has its major basc of operations within the Union, or any other appropriatc authority of the Union by agreement with that appropriatc authority, for air carriers not listed in the Annex to Regulation (EU) No 394/2011 and not holding an Air Operator's Certificate issued by a Member Statc; if satisfied with the report of the independent validator, thc appropriate authority concerned shall ensure that the necessary details of the ACC3 are entered into the Union database of regulated agents and known consignors; when making the database entry, the appropriate authority concerned shall allocate a unique alphanumeric identifier in the standard format identifying the carrier and the third country airport from which it is carryinu, cnrpo into the Union. The uninue alphanutneric identifier shall appear on documentation accompanying the consignments carried, cither in electronic tormat or in writing; if the appropriatc authority concerned is not satisfied with the information provided by the air carrier or with the report of the independent validation then the reasons shall promptly bc notified to the carricr seeking designation as an ACC3; an ACC3 listed on the Union database of regulated agents and known consignors in accordance with this point shall be recognised in all Member States for all operations from the third country airport into the Union; an ACC3 listed in the Union database of regulated agents and known consignors shall be re-validated at intervals not exceeding 5 years at the third country airport for which it has been designated and resubmit a Declaration of Commitments at the time of each revalidation Security controls for cargo and mail arriving from a third country The ACC3 shall ensure that all cargo and mail carried for transfer, transit or unloading at a Union airport is screened, unless: (a) the required security controls have been applied to the consignment by a regulated agent and the consignment has been protected from unauthorised interference from the time that those security controls were applied and until loading; or

16 EN Official Journal of the European UnionL 220/13 the required security controls have been applied to the consignment by a known consignor and the consignment been protected ri-om unt1, 11.)risLJ inteiler;...nce from the time 11-Klt Ibos( secufily controls were applied and until loading; or the required security controls have been applied to the consignment by an account consignor, the consignment has been protected from unauthorised interference from the time that those security controls were applied and until loading, and it is not carried on a passenger aircraft; or the consignment is exempted from screcning in accordance with point 6.1.1(d) and protected from unauthorised interference from the time that it became klentifiable air cargo or identifiable air mail and until loading Until 30 June 2014, the requirernents of point shall, as a minimum, meet ICAO standards. Thereafter, cargo and mail carried into the Union shall be: screened by one of the mcans or methods listed in point to a standard sufficient to reasonably ensure that it contains no prohibited articles; or subject to security controls by a regulated agent, known consignor or account consignor designated in accordance with point 6.8.3; or exempted from screening in accordance with point 6.1.1(d) and protected from unauthorised interference from the time that it became identifiable air cargo or identifiable air mail and until loading The security status of the consignment shall be indicated in the accompanying documentation, either in the form of an air waybill, equivalent postal documentation or in a separate declaration and either in an electronic fonnat or in writing Designation of third country regulated agents, known consignors and account consignors Until 30 June 2014, the ACC3 shall set out details of security controls implemented by regulated agents, known consignors and account consignors from which it directly accepts consignments in its security programme. Thereafter, the ACC3 shall in addition: ensure that such third country regulated agents and known consignors are independently validated in accordance with the checklists in Attachments 6-C2 and 6-C respectively at intervals not exceeding 5 years; ensure that completed checklists arc available for inspection by the appropriate authority or the Commission; maintain a database giving the following information for each such regulated agent, known consignor and account consignor: ---- the company details, including the bona fide business address, the nature of the business, excluding business sensitive information, contact details, including those of the person(s) responsible for security, the company registration number, if applicable. The database shall be available for inspection For third country account consignors from which it directly accepts consignments the ACC3 shall ensure that the requirements of points to are met. Third country Authorised Economic Operator AEO certificates may only be recognised for third countries with which the Union has concluded an AEO Mutual Recognition agreement Non-compliance If the Commission or an appropriate authority identifies a scrious deficiency relating to an ACC3 operation which is deemed to have a significant impact on the overall level of aviation security in the Union it shall: inform the ACC3 concerned promptly and request comments; promptly inform the Commission and other Member States, as appropriate.

Methods and technologies for the detection of explosives develop over time. In line with the evolution of the threat to dvil aviation, technological developrnents and operation experiences both at Union and global levd, the Commission should revise the technological and operation provisions relating to explosives detection systems. Regulation (EU) No 185/2010 should therefore be amended accordingly. Detailed requirements on these standards are laid down in a separate Commission Decision, All EDS shall meet standard Standard 1 shall expire on 1 September The appropriate authority rnay permit standard 1 EDS installed between 1 January 2003 and 1 September 2006 to continue to be used until 1 January 2014 at the latest Standard 2 shall apply to all EDS installed as from 1 January 2007, unless a contract to install EDS that meets standard 1 has been placed before 19 October All EDS shall meet standard 2 by 1 September 2012 at the latest, unless point applies Standard 2 shall expire on 1 September The appropriate authority may permit standard 2 EDS installed between I January 2011 and 1 September 2014 to continue to be used until 1 September 2022 at the latest The appropriate authority shall inform the Commission when it grants permission to permit standard 2 EDS to continue to be used as of I September Standard 3 shall apply to all EDS installed as from 1 September All EDS shall meet standard 3 by 1 September 2020 at the latest, unless point applies.'
